عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ عُمَرَ بْنِ أُذَيْنَةَ عَنْ زُرَارَةَ عَنْ أَبِي جَعْفَرٍ ع قَالَ:

سَأَلْتُهُ عَنْ مَمْلُوكٍ تَزَوَّجَ بِغَيْرِ إِذْنِ سَيِّدِهِ فَقَالَ ذَاكَ إِلَى سَيِّدِهِ إِنْ شَاءَ أَجَازَهُ وَ إِنْ شَاءَ فَرَّقَ بَيْنَهُمَا قُلْتُ أَصْلَحَكَ اللَّهُ إِنَّ الْحَكَمَ بْنَ عُتَيْبَةَ وَ إِبْرَاهِيمَ النَّخَعِيَّ وَ أَصْحَابَهُمَا يَقُولُونَ إِنَّ أَصْلَ النِّكَاحِ فَاسِدٌ وَ لَا تَحِلُّ إِجَازَةُ السَّيِّدِ لَهُ فَقَالَ أَبُو جَعْفَرٍ ع إِنَّهُ لَمْ يَعْصِ اللَّهَ إِنَّمَا عَصَى سَيِّدَهُ فَإِذَا أَجَازَهُ فَهُوَ لَهُ جَائِزٌ.

Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Umar Bin Azina, from Zurara, (It has been narrated) from Abu Ja’far asws , said, ‘I asked him asws about an owned slave who got married without a permission of his master. So he asws said: ‘That is up to his master, if he so desires to he allows it, and if he so desires to he effects separation between the two of them’. I said, ‘May Allah azwj Keep you asws well! Al-Hakam Bin Uteyba, and Ibrahim Al-Nakhai’e, and their companions are saying that the origin of the marriage is spoilt, and it is not Permissible for the master to allow it for him’. So Abu Ja’far asws said to him: ‘He did not disobey Allah azwj . But rather, he disobeyed his master. So when he allows it, so it is allowed for him’.
