الْعَقِيقَةُ وَاجِبَةٌ إِذَا وُلِدَ لِلرَّجُلِ وَلَدٌ فَإِنْ أَحَبَّ أَنْ يُسَمِّيَهُ مِنْ يَوْمِهِ فَعَلَ.

1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Ali ibn abu Hamzah from the virtuous servant (of Allah) (a.s.), who has said the following: “He (the virtuous servant of Allah, the Imam) (a.s.), has said, ‘ ‘Aqiqah is obligatory when a child is born to one, and if he likes to give him a name on that day he can do so.’”

[1]العقيقة: الذبيحة التي تذبح عن المولود و أصل العق: الشق و قيل للذبيحة. عقيقة لأنّها يشق حلقها.( النهاية) و لا خلاف بين الاصحاب في وقتها و هو اليوم السابع و اختلف في حكمها قال السيّد و ابن الجنيد: انها واجبة و ادعى السيّد عليه الإجماع و هو ظاهر الكليني أيضا و ذهب الشيخ و من تأخر عنه إلى الاستحباب و المسألة محل اشكال و الاحتياط ظاهر.( آت)ص 24
