عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ وَ عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ عُثْمَانَ بْنِ عِيسَى عَنْ سَمَاعَةَ قَالَ:

سَأَلْتُهُ عَنِ الرَّجُلِ يَقُولُ يَوْمَ أَتَزَوَّجُ فُلَانَةَ فَهِيَ طَالِقٌ فَقَالَ لَيْسَ بِشَيْءٍ إِنَّهُ لَا يَكُونُ طَلَاقٌ حَتَّى يَمْلِكَ عُقْدَةَ النِّكَاحِ.

2. A number of our people have narrated from Ahmad ibn Muhammad from and Ali ibn Ibrahim has narrated from his father from ‘Uthman ibn ‘Isa from Sama‘ah who has said the following: “I once asked him (the Imam) (a.s.), about the case of a man who says that on the day I will get married to so and so she is divorced. He (the Imam) said, ‘It does not have any valid effect until he has a binding marriage.’”
