مُحَمَّدٌ عَنْ أَحْمَدَ عَنِ الْحُسَيْنِ بْنِ سَعِيدٍ عَنْ أَخِيهِ الْحَسَنِ عَنْ زُرْعَةَ بْنِ مُحَمَّدٍ عَنْ سَمَاعَةَ قَالَ:

سَأَلْتُهُ ع عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ وَ هُوَ مَرِيضٌ قَالَ تَرِثُهُ مَا دَامَتْ فِي عِدَّتِهَا وَ إِنْ طَلَّقَهَا فِي حَالِ إِضْرَارٍ فَهِيَ تَرِثُهُ إِلَى سَنَةٍ فَإِنْ زَادَ عَلَى السَّنَةِ يَوْماً وَاحِداً لَمْ تَرِثْهُ وَ تَعْتَدُّ مِنْهُ أَرْبَعَةَ أَشْهُرٍ وَ عَشْراً عِدَّةَ الْمُتَوَفَّى عَنْهَا زَوْجُهَا.

9. Muhammad has narrated from Ahmad from al-Husayn ibn Sa‘id from his brother al-Hassan from Zur’ah ibn Muhammad from Sama‘ah who has said the following: “I once asked abu ‘Abd Allah (a.s.), about the case of a man who divorces his wife when he is ill. He (the Imam) said that she inherits his legacy. She inherits him as long as she is in her waiting period. If he has divorced her in a condition that harms her, she inherits him up to one year; and if it is more than one year even by one day, then she does not inherit and she counts a waiting period for four months and ten days like the waiting period for a widow.’”

[1]اختلف الاصحاب في ان ثبوت الارث للمطلقة في المرض هل هو مترتب على مجرد الطلاق فيه او معلل بتهمته فذهب الشيخ في كتابى الفروع و الاكثر الى الأول لإطلاق النصوص و ذهب في الاستبصار إلى الثاني لرواية سماعة و رجحه العلامة في المختلف و الإرشاد.( آت)ص 122
[1]لعل العدة فيما إذا مات في العدة لا في بقية السنة، و لا يبعد أن يكون يلزمها العدة في تمام السنة لثبوت الارث لكن لم أر به قائلا.( آت)ص 123
