سَأَلْتُ أَبَا جَعْفَرٍ ع عَنِ الْخِيَارِ فَقَالَ وَ مَا هُوَ وَ مَا ذَاكَ إِنَّمَا ذَاكَ شَيْءٌ كَانَ لِرَسُولِ اللَّهِ ص.

1. Muhammad ibn abu ‘Abd Allah has narrated from Mu‘awiyah ibn Hakam from Safwan and Ali ibn al-Husayn ibn Ribat from abu Ayyub al-Khazzaz from Muhammad ibn Muslim who has said the following: “I once asked abu Ja‘far (a.s.), about choices. He (the Imam) said, ‘Who is he and what is that; it was something only for the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause.’”

[1]قال الشهيد- رحمه اللّه- في المسالك: اتفق علماء الإسلام من عدا الاصحاب على جواز تفويض الزوج أمر الطلاق الى المرأة و تخييرها في نفسها ناويا به الطلاق و وقوع الطلاق لو اختارت نفسها و اما الاصحاب فاختلفوا فذهب جماعة منهم ابن الجنيد و ابن أبي عقيل و السيّد و ظاهر ابنى بابويه الى وقوعه به إذا اختارت نفسها بعد تخييره لها على الفور مع اجتماع شرائط الطلاق.ص 136
