مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ عِيسَى عَنْ سَعْدِ بْنِ إِسْمَاعِيلَ بْنِ الْأَحْوَصِ عَنْ أَبِيهِ قَالَ:

سَأَلْتُ أَبَا الْحَسَنِ ع عَنْ رَجُلٍ مُسَافِرٍ حَضَرَهُ الْمَوْتُ فَدَفَعَ مَالَهُ إِلَى رَجُلٍ مِنَ التُّجَّارِ فَقَالَ إِنَّ هَذَا الْمَالَ لِفُلَانِ بْنِ فُلَانٍ لَيْسَ لِي فِيهِ قَلِيلٌ وَ لَا كَثِيرٌ فَادْفَعْهُ إِلَيْهِ يَضَعُهُ حَيْثُ يَشَاءُ فَمَاتَ وَ لَمْ يَأْمُرْ صَاحِبَهُ الَّذِي جَعَلَ لَهُ بِأَمْرٍ وَ لَا يَدْرِي صَاحِبُهُ مَا الَّذِي حَمَلَهُ عَلَى ذَلِكَ كَيْفَ يَصْنَعُ بِهِ قَالَ يَضَعُهُ حَيْثُ يَشَاءُ إِذَا لَمْ يَكُنْ يَأْمُرُهُ.

23. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa from Sa‘d ibn ’Isma‘ii ibn ai-Ahwas from his father who has narrated the following: “I once asked abu al-Hassan (a.s.), about the case of a man whose death approaches him on a journey. He gives his assets to a man of the merchants saying, ‘This asset belongs to so and so son of so and so. Nothing of it, little or more, belongs to me. You must give it to him, he will place it as he wants’; and he dies, but his friend to whom he has sent the asset does not know anything, there is no instruction and the friend does not know why he has done so. How must he deal with it?’ He (the Imam) said, ‘He can spend it as he likes when he has not received any instructions.’”

[1]أي هو ماله يصرفه حيث يشاء اذ ظاهر إقراره أنّه اقر له بالملك و يكفى ذلك في جواز تصرفه و لا يلزم علمه بسبب ذلك، و يحتمل أن يكون المراد أنّه أوصى إليه بصرف هذا المال في اي مصرف شاء فهو مخير للصرف فيه مطلقا او في وجوه البر.( آت)ص 64
