عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ عُمَرَ بْنِ أُذَيْنَةَ عَنْ زُرَارَةَ وَ بُكَيْرٍ وَ الْفُضَيْلِ وَ مُحَمَّدٍ وَ بُرَيْدٍ عَنْ أَحَدِهِمَا ع قَالَ:

إِنَّ الْجَدَّ مَعَ الْإِخْوَةِ مِنَ الْأَبِ يَصِيرُ مِثْلَ وَاحِدٍ مِنَ الْإِخْوَةِ مَا بَلَغُوا قَالَ قُلْتُ رَجُلٌ تَرَكَ أَخَاهُ لِأَبِيهِ وَ أُمِّهِ وَ جَدَّهُ أَوْ قُلْتُ تَرَكَ جَدَّهُ وَ أَخَاهُ لِأَبِيهِ وَ أُمِّهِ قَالَ الْمَالُ بَيْنَهُمَا وَ إِنْ كَانَا أَخَوَيْنِ أَوْ مِائَةَ أَلْفٍ فَلَهُ مِثْلُ نَصِيبِ وَاحِدٍ مِنَ الْإِخْوَةِ قَالَ قُلْتُ رَجُلٌ تَرَكَ جَدَّهُ وَ أُخْتَهُ فَقَالَ لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ وَ إِنْ كَانَتَا أُخْتَيْنِ فَالنِّصْفُ لِلْجَدِّ وَ النِّصْفُ الْآخَرُ لِلْأُخْتَيْنِ وَ إِنْ كُنَّ أَكْثَرَ مِنْ ذَلِكَ فَعَلَى هَذَا الْحِسَابِ وَ إِنْ تَرَكَ إِخْوَةً وَ أَخَوَاتٍ لِأَبٍ وَ أُمٍّ أَوْ لِأَبٍ وَ جَدّاً فَالْجَدُّ أَحَدُ الْإِخْوَةِ فَالْمَالُ بَيْنَهُمْ لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ قَالَ زُرَارَةُ هَذَا مِمَّا لَا يُؤْخَذُ عَلَيَّ فِيهِ قَدْ سَمِعْتُهُ مِنْ أَبِيهِ وَ مِنْهُ قَبْلَ ذَلِكَ وَ لَيْسَ عِنْدَنَا فِي ذَلِكَ شَكٌّ وَ لَا اخْتِلَافٌ.

2. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from ‘Umar ibn ’Udhaynah from Zurarah and Bukayr and al- Fudayl and Muhammad and Burayd who has narrated the following: “One of the two Imam, (abu Ja‘far or abu ‘ Abd Allah), ‘Alayhim al-Salam, has said, ‘The grandfather with brothers from the father’s side become like one of the brothers regardless of how many they are.’ He (the narrator) has said that I asked, ‘A man has left his brother from his mother and father and his grandfather’, or I asked, ‘He has left his grandfather, his brother from his father and mother.’ He (the Imam) said, ‘The legacy is given to them, regardless, one or one hundred thousand he (grandfather) receives the share of one brother.’ I then asked, ‘A man has left behind his grandfather and his sister.’ He (the Imam) said, ‘The male receives like the share of two females. If they are two sisters then one- half is for grandfather and the other one-half for the two sisters. However, if they are more, it then is like the above calculation, if he leaves brothers and sisters from father and mother and grandfather then the grandfather is like one of the brothers and the legacy among them is distributed, each male receiving twice the share of a female.’” Zurarah has said, ‘This is what I cannot be questioned for because I heard it from his father and from him (the Imam) before and we have no doubt about it or differences.’”

[1]تلك الاخبار محمولة على اتّحاد الجهة بان كان الجد للاب مع الاخوة للاب او للاب و الام او كان الجد للام مع الاخوة من قبلها في خبر لم يذكر فيه فضل الذكور على الاناث و ان كان يمكن تعميم قوله:« مثل واحد من الاخوة» بحيث يشتمل صور الاختلاف أيضا لانه يصدق أنّه مثل واحد من الاخوة لكن لا من الاخوة الموجودين بل لو كانت اخوة من تلك الجهة لكنه بعيد جدا، و قال في الدروس: للجد المنفرد المال لاب كان أو لأم و كذا الجدة و لو اجتمعا من طرف واحدة تقاسما المال للذكر مثل حظ الانثيين ان كانا لاب و بالسوية ان كانا لام.( آت)ص 109
