سَمِعْتُ أَبَا عَبْدِ اللَّهِ ع يَقُولُ فِي السِّقْطِ إِذَا سَقَطَ مِنْ بَطْنِ أُمِّهِ فَتَحَرَّكَ تَحَرُّكاً بَيِّناً يَرِثُ وَ يُورَثُ فَإِنَّهُ رُبَّمَا كَانَ أَخْرَسَ.

2. Ali has narrated from his father from Hammad ibn ‘Isa from Rib‘iy who has narrated the following: “I once heard abu ‘Abd Allah (a.s.), saying, ‘If a miscarried child falls off the womb of his mother and moves with clear movement, he inherits and is inherited; perhaps he is speechless so that he did not cry.’”

[1]استهلال الصبى تصويته عند الولادة. قال في الدروس ارث الحمل ممنوع الا ان ينفصل حيا و لو سقط ميتا لم يرث لقوله:« السقط لا يرث و لا يورث» و لا يشترط حياته عند موت المورث فلو كان نطفة ورث إذا انفصل حيا و لا يشترط استقرار الحياة فلو سقط بجناية جان و تحرك حركة تدلّ على الحياة ورث و انتقل ماله الى وارثه و لا اعتبار بالتقلص الطبيعي، و لو خرج بعضه ميتا لم يرث و لا يشترط الاستهلال لانه قد يكون أخرس بل تكفى الحركة البينة و رواية عبد اللّه بن سنان باشتراط صوته محمولة على التقية.( آت)ص 155
