بَابُ حَدِّ الْمُرْتَدِّ

عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ وَ مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ جَمِيعاً عَنِ ابْنِ مَحْبُوبٍ عَنِ ابْنِ رِئَابٍ عَنْ أَبِي عُبَيْدَةَ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ:

الْعَبْدُ إِذَا أَبَقَ مِنْ مَوَالِيهِ ثُمَّ سَرَقَ لَمْ يُقْطَعْ وَ هُوَ آبِقٌ لِأَنَّهُ مُرْتَدٌّ عَنِ الْإِسْلَامِ وَ لَكِنْ يُدْعَى إِلَى الرُّجُوعِ إِلَى مَوَالِيهِ وَ الدُّخُولِ فِي الْإِسْلَامِ فَإِنْ أَبَى أَنْ يَرْجِعَ إِلَى مَوَالِيهِ قُطِعَتْ يَدُهُ بِالسَّرِقَةِ ثُمَّ قُتِلَ وَ الْمُرْتَدُّ إِذَا سَرَقَ بِمَنْزِلَتِهِ.

A number of our companions, from Sahl Bin Ziyad and Muhammad Bin Yahya, from Ahmad Bin Muhammad, altogether from Ibn Mahboub, from Ibn Raib, from Abu Ubeyda, Abu Abdullah asws has said: ‘The slave, when he is a fugitive from his master, then steals, he would not be cut, and he is a fugitive, because he is a renegade from Al-Islam, but he would be called to the return to his master, and the entry into the fold of Al-Islam. So if he were to refuse to return to his master, his hand would be cut due to the theft, then he would be killed; and the apostate, when he steals is at his status’.
