أُتِيَ رَسُولُ اللَّهِ ص بِرَجُلٍ قَدْ ضَرَبَ امْرَأَةً حَامِلًا بِعَمُودِ الْفُسْطَاطِ فَقَتَلَهَا فَخَيَّرَ رَسُولُ اللَّهِ ص أَوْلِيَاءَهَا أَنْ يَأْخُذُوا الدِّيَةَ خَمْسَةَ آلَافِ دِرْهَمٍ وَ غُرَّةٌ وَصِيفٌ أَوْ وَصِيفَةٌ لِلَّذِي فِي بَطْنِهَا أَوْ يَدْفَعُوا إِلَى أَوْلِيَاءِ الْقَاتِلِ خَمْسَةَ آلَافِ [دِرْهَمٍ] وَ يَقْتُلُوهُ.

Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Al Hassan Bin Mahboub, from Abu Wallad, from Abu Maryam Al Ansary, (It has been narrated) from Abu Ja’far asws having said: ‘They came to Rasool-Allah saww with a man who has struck a pregnant woman with a pole of a tent, so he killed her. So Rasool-Allah saww gave a choice to her guardians that they can take the wergild of five thousand Dirhams, and for negligence, a male servant or a female servant for that which was in her belly, or hand over five thousand Dirham to the guardians of the killer, and they can kill him’.
