بَعَثَ رَسُولُ اللَّهِ ص جَيْشاً إِلَى خَثْعَمَ فَلَمَّا غَشِيَهُمُ اسْتَعْصَمُوا بِالسُّجُودِ فَقُتِلَ بَعْضُهُمْ فَبَلَغَ ذَلِكَ النَّبِيَّ ص فَقَالَ أَعْطُوا الْوَرَثَةَ نِصْفَ الْعَقْلِ بِصَلَاتِهِمْ وَ قَالَ النَّبِيُّ ص أَلَا إِنِّي بَرِيءٌ مِنْ كُلِّ مُسْلِمٍ نَزَلَ مَعَ مُشْرِكٍ فِي دَارِ الْحَرْبِ.

1. Ali ibn Ibrahim has narrated from his father, from af-Nawfafiy from af-Sakuniy who has said the following: “Abu ‘ Abd Allah (a.s.), has said that once, the Messenger of Allah dispatched an army against the KhatlTam. When this army was overpowered by the enemy they sought protection by performing prostration. Certain ones among them were killed. When the news reached the Holy Prophet he said, ‘You must pay half of the amount of compensation for their lives because of their prayer.’ The Holy Prophet said, ‘I certainly denounce one who is a Muslim and yet goes to reside in the war zone with the pagans.’”

[1]قال البكرى في معجم ما استعجم: خثعم- بفتح أوله و اسكان ثانيه، بعده عين مهملة و ميم-: اسم جبل بالسراة، فمن نزله فهو خثعمى، قاله الخليل و الزبير بن بكار و قال أبو عبيدة: خثعم:ص 43
[2]قوله:« نصف العقل» لم أر من أصحابنا من تعرض لهذا الحكم و هذا الخبر مرويّ من طرق المخالفين قال في النهاية: العقل الدية و منه حديث جرير« فاعتصم ناس منهم بالسجود فاسرع فيهم القتل فبلغ ذلك إليه صلّى اللّه عليه و آله فأمر لهم بنصف العقل و انما امر لهم بنصف بعد علمه باسلامهم لانهم قد اعانوا على أنفسهم بمقامهم بين ظهرانى الكفّار فكانوا كمن هلك بجناية نفسه و جناية غيره فتسقط حصة جنايته من الدية.( آت)ص 43
