مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ وَ عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ جَمِيعاً عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادٍ عَنِ الْحَلَبِيِّ قَالَ:

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنْ رَجُلٍ أَسْلَفْتُهُ دَرَاهِمَ فِي طَعَامٍ فَلَمَّا حَلَّ طَعَامِي عَلَيْهِ بَعَثَ إِلَيَّ بِدَرَاهِمَ فَقَالَ اشْتَرِ لِنَفْسِكَ طَعَاماً وَ اسْتَوْفِ حَقَّكَ قَالَ أَرَى أَنْ يُوَلَّى ذَلِكَ غَيْرُكَ وَ تَقُومَ مَعَهُ حَتَّى تَقْبِضَ الَّذِي لَكَ وَ لَا تَتَوَلَّى أَنْتَ شِرَاهُ.

5. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad and Ali ibn Ibrahim has narrated from his father all from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man to whom I made advance payment for foodstuff. When the time arrived he sent to me dirhams. He (the Imam) said, ‘Buy foodstuff for yourself and compensate for your right.’ He (the Imam) then said, ‘I deem it proper that you appoint someone else for such work until you receive what belongs to you and you alone must not undertake the task and work.’”

[2]انما منعه أن يتولى شراء ذلك بنفسه لانه ربما تكون الدراهم المبعوثة أزيد من رأس ماله فاذا أخذها مكانه يوهم أنّه رباء و فقه هذه المسألة ان البائع إذا ردّ الدراهم على ان يفسخ البيع الأول لعجزه عن المبيع المضمون فأخذ الزائد على رأس المال منه غير جائز فالاخبار المتضمنة لمنع اخذ الزائد في هذا الباب كلها محمولة على الأول و المتضمنة لجوازه محمولة على الثاني و الجواز لا يخلو عن كراهة الا للفقيه بالمسألة كما يشعر به بعض تلك الاخبار و بهذا يندفع التنافى عنهما لا بما في الاستبصار.( فى)ص 185
