لَا بَأْسَ بِأَنْ يَتَمَتَّعَ الرَّجُلُ بِأَمَةِ الْمَرْأَةِ فَأَمَّا أَمَةُ الرَّجُلِ فَلَا يَتَمَتَّعْ بِهَا إِلَّا بِأَمْرِهِ.

4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Sayf ibn ‘Amirah who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘It is not unlawful for one to marry in the manner of al- Mut‘ah (advantageous marriage) the slave-girl of a woman but if the master is a man then al-Mut‘ah (advantageous marriage) with her is not permissible without the permission of her master.’”

[1]ذكر في هامش المطبوع أن ما تضمنه هذا الخبر من جواز التمتع بامة المرأة بدون اذن مولاها بخلاف امة الرجل ممّا لم يقل به أحد من أصحابنا الإماميّة و في معناه وردت روايتان اخريان و الأصل فيهما أيضا سيف بن عميرة لكنه يرويهما عن أبي عبد اللّه عليه السلام بواسطة و مثل هذه الأخبار الثلاثة التي يكون الأصل فيهما واحدا مع الاختلاف في روايته ممّا لا يجوز العمل به لمخالفته لقوله تعالى:« فَانْكِحُوهُنَّ بِإِذْنِ أَهْلِهِنَّ» الشامل للرجال و النساء و للاخبار الصحيحة الواردة في هذا المسألة أيضا كذا ذكره الشيخ في الاستبصار.( رفيع).ص 464
