وَ رَوَى إِبْرَاهِيمُ بْنُ عُمَرَ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ اللُّقَطَةُ لُقَطَتَانِ لُقَطَةُ الْحَرَمِ تُعَرِّفُ سَنَةً فَإِنْ وَجَدْتَ صَاحِبَهَا وَ إِلَّا تَصَدَّقْتَ بِهَا وَ لُقَطَةُ غَيْرِ الْحَرَمِ تُعَرِّفُهَا سَنَةً فَإِنْ جَاءَ صَاحِبُهَا وَ إِلَّا فَهِيَ كَسَبِيلِ مَالِكَ.

Hadith.2349 - It has been narrated from Ibrahim ibn Umar, from Abu Abdullah (as), who said: "There are two types of lost property (luqata). As for the lost property of the Haram, you must announce it for one year. If you find its owner, return it; otherwise, give it in charity. As for lost property outside the Haram, announce it for one year. If its owner comes, return it; otherwise, it becomes like your own property." It has also been narrated: "Among the names of Mecca are: Mecca, Bakkah, Umm al-Qura, Umm al-Rahm, and Al-Bassah. When people commit oppression there, it destroys them (bassathum, meaning annihilates them), and when they are oppressed there, they are shown mercy."

[2]الخبر صحيح و ظاهره جواز أخذ لقطة الحرم و عدم جواز تملكها بعد التعريف و اختلف الاصحاب في ذلك اختلافا كثيرا فذهب الشيخ في النهاية و جماعة الى أنّه لا تحل لقطة الحرم مطلقا، و ذهب المحقق في النافع و جماعة الى الكراهة مطلقا، و ذهب جماعة الى جواز القليل مطلقا، و الكثير على كراهية مع نية التعريف، و القول بالكراهة لا يخلو من قوة، ثم اختلف في حكمها بعد الالتقاط فذهب المحقق و جماعة الى التخيير بين التصدق و لا ضمان، و بين ابقائها أمانة لانه لا يجوز التملك مطلقا و قال في موضع آخر يجوز تملك ما دون الزائد و خير بين ابقائها أمانة و التصدق و لا ضمان، و نقل عن أبي الصلاح أنّه يجوز تملك الكبير أيضا و الأظهر و الأحوط وجوب التصدق بها بعد التعريف كما دل عليه هذا الخبر.( المرآة).ص 256
