إِنِّي لَمْ أُشْهِدْهُ قَالَ تَجُوزُ شَهَادَةُ أَعْدَلِهِمَا وَ إِنْ كَانَتْ عَدَالَتُهُمَا وَاحِدَةً لَمْ تَجُزْ شَهَادَتُهُ.

Hadith.3353 - It is narrated from Abdullah ibn Sinan, from Abdurrahman ibn Abi Abdullah, from Abu Abdullah (as) regarding a man who testified based on the testimony of another man, and then the original man said: 'I did not make him a witness,' Imam (as) said: "The testimony of the more upright of the two is accepted, but if their uprightness is equal, then his testimony is not accepted."

[2]عمل الشيخ في النهاية و جماعة بمدلول الخبر و قالوا: ان كذب الفرع الأصل تعمل بشهادة أعدلهما فان تساويا طرح الفرع، و الأشهر بين المتأخرين هو أنّه ان كان قبل حكم الحاكم لا عبرة بشهادة الفرع مع تكذيب الأصل و ان كان بعده نفذ حكم الحاكم و لا عبرة بقول الأصل فيحملون هذا الخبر و أمثاله على ما إذا شك الأصل قبل حكم الحاكم فينفذ بعده مطلقا، و منهم من قال به بعد الحكم فيبطل شهادة الفرع قبل مطلقا، و الأول أقوى لصحة الخبر.ص 70
