رَوَى أَبُو بَكْرٍ الْحَضْرَمِيُّ عَنِ الْوَرْدِ بْنِ زَيْدٍ قَالَ قُلْتُ

لِأَبِي جَعْفَرٍ ع حَدِّثْنِي حَدِيثاً وَ أَمْلِ عَلَيَّ حَتَّى أَكْتُبَهُ فَقَالَ أَيْنَ حِفْظُكُمْ يَا أَهْلَ الْكُوفَةِ قُلْتُ حَتَّى لَا يَرُدَّهُ عَلَيَّ أَحَدٌ- مَا تَقُولُ فِي مَجُوسِيٍّ قَالَ بِسْمِ اللَّهِ وَ ذَبَحَ فَقَالَ كُلْ فَقُلْتُ مُسْلِمٌ ذَبَحَ وَ لَمْ يُسَمِّ فَقَالَ لَا تَأْكُلْ إِنَّ اللَّهَ تَعَالَى يَقُولُ- فَكُلُوا مِمَّا ذُكِرَ اسْمُ اللَّهِ عَلَيْهِ وَ يَقُولُ وَ لا تَأْكُلُوا مِمَّا لَمْ يُذْكَرِ اسْمُ اللَّهِ عَلَيْهِ.

Hadith.4182 - And Abu Bakr al-Hadrami narrated from Al-Ward bin Zaid, who said: I said to Abu Ja'far Imam Muhammad ibn Ali Al-Baqir (as), 'Relate to me a narration and dictate it to me so that I may write it down.' Imam (as) said: 'Where is your memory, O people of Kufa?' I said: 'So that no one disputes it with me later.' I then asked: 'What do you say about a Magian who says 'In the name of Allah (swt)' and slaughters an animal?' Imam (as) said: 'Eat.' I said: 'What if a Muslim slaughters but does not mention the name of Allah (swt)?' Imam (as) replied: 'Do not eat. Indeed, Allah (swt), the Exalted, says: 'So eat of that upon which the name of Allah (swt) has been mentioned' (Surah Al-An'am 6:118) and He (swt) also says: 'And do not eat of that upon which the name of Allah (swt) has not been mentioned.' (Surah Al-An'am 6:121)'"

[2]أقول في قبال هذه الأخبار أخبار تدلّ على عدم حلية ذبائح أهل الكتاب راجع التهذيبين و حمل الشيخ أخبار الاباحة أولا على حال الضرورة دون حال الاختيار لان عند الضرورة تحل الميتة فكيف ذبيحة من خالف الإسلام و استدلّ بصحيحة زكريا بن آدم قال: قال لي أبو الحسن عليه السلام:« انى أنهاك عن ذبيحة كل من كان على خلاف الذي أنت عليه و أصحابك الا في وقت الضرورة إليه». و ثانيا على التقية و قال: ان جميع من خالفنا يرى اباحة ذلك.ص 331
