لَا رَجْمَ عَلَيْهِ حَتَّى يُوَاقِعَ الْحُرَّةَ بَعْدَ مَا يُعْتَقُ قُلْتُ فَلِلْحُرَّةِ عَلَيْهِ الْخِيَارُ إِذَا أُعْتِقَ قَالَ لَا قَدْ رَضِيَتْ بِهِ

Hadith.5029 - Al-Hasan ibn Mahbub narrated from Ali ibn Ri'ab, who reported from Abu Abdullah (as) regarding a slave who marries a free woman and is later emancipated but then commits an immoral act. Imam (as) said: "There is no stoning (rajm) upon him until he engages in intercourse with the free woman after his emancipation." I asked: "Does the free woman have the option (to leave him) when he is freed?" Imam (as) replied: "No, for she accepted him while he was a slave, and he remains upon his original marriage."
