وَ رَوَى عَمَّارُ بْنُ مُوسَى السَّابَاطِيُّ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ:

سَأَلْتُهُ عَنْ رَجُلٍ شَهِدَ عَلَيْهِ ثَلَاثَةُ رِجَالٍ أَنَّهُ زَنَى بِفُلَانَةَ وَ شَهِدَ الرَّابِعُ أَنَّهُ لَا يَدْرِي بِمَنْ زَنَى قَالَ لَا يُحَدُّ وَ لَا يُرْجَمُ وَ سُئِلَ عَنْ مُحْصَنَةٍ زَنَتْ وَ هِيَ حُبْلَى قَالَ تُقَرُّ حَتَّى تَضَعَ مَا فِي بَطْنِهَا وَ تُرْضِعَ وَلَدَهَا ثُمَّ تُرْجَمُ.

Hadith.5035 - It is narrated from Ammar ibn Musa Al-Sabati that Abu Abdullah (as) said: I asked Imam (as) about a man against whom three men testified that he had committed adultery with a certain woman, but the fourth witness testified that he did not know with whom the man had committed adultery. Imam (as) replied: "He is neither to be punished with lashes nor stoned." Imam (as) was also asked about a married woman who committed adultery and was pregnant. Imam (as) said: "She should be kept until she gives birth to what is in her womb and nurses her child, then she is to be stoned."

[3]رواه الكليني ج 7 ص 210 بسند مجهول، و يدلّ على أن مع ذكرهم لمن وقع عليها الزنا يلزم اتفاقهم فيها، و لا يدلّ على أنّه لا يجب التعرض لمن وقع عليها كما يفهم من بعض الاصحاب و ليس في الخبر حدّ الشهود و ظاهر الاصحاب انهم يحدون.( المرآة).ص 39
[4]تتمة لخبر عمّار كما يظهر من التهذيب، و يدلّ على أنّه لا ترجم الحامل حتّى تضع و ترضع ولدها، و استشكل بأن ذلك يمكن أن يكون لعدم الثبوت بالإقرار أربع مرّات.ص 39
