بَابُ مَا يَجِبُ فِيهِ الْفِدَاءُ مِنْ لُبْسِ الثِّيَابِ‌

عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ وَ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ مَحْبُوبٍ عَنْ عَلِيِّ بْنِ رِئَابٍ عَنْ زُرَارَةَ عَنْ أَبِي جَعْفَرٍ ع قَالَ:

مَنْ لَبِسَ ثَوْباً لَا يَنْبَغِي لَهُ لُبْسُهُ وَ هُوَ مُحْرِمٌ فَفَعَلَ ذَلِكَ نَاسِياً أَوْ سَاهِياً أَوْ جَاهِلًا فَلَا شَيْ‌ءَ عَلَيْهِ وَ مَنْ فَعَلَهُ مُتَعَمِّداً فَعَلَيْهِ دَمٌ.

1. A number of our people have narrated from Sahl ibn Ziyad and Ahmad ibn Muhammad from ibn Mahbub from Ali ibn Ri’ab from Zurarah who has said the following: “Abu Ja‘far (a.s.), has said, ‘If one in the state of Ihram wears a cloth which he is not supposed to wear and one does it out of forgetfulness, ignorance or by mistake, there is not anything on him; but if one does it knowingly, one must offer an offering animal.’”

[1]يمكن الفرق بينهما بحمل أحدهما على نسيان الاحرام و الآخر على نسيان الحكم و هو موافق لما هو المشهور من عدم لزوم الكفّارة على الناسى و الجاهل في غير الصيد بل لا نعلم فيه مخالفا.( آت)ص 348

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ حَمَّادٍ عَنْ حَرِيزٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَحَدِهِمَا ع قَالَ:

سَأَلْتُهُ عَنْ ضُرُوبٍ مِنَ الثِّيَابِ مُخْتَلِفَةٍ يَلْبَسُهَا الْمُحْرِمُ إِذَا احْتَاجَ مَا عَلَيْهِ قَالَ لِكُلِّ صِنْفٍ مِنْهَا فِدَاءٌ.

2. Ali ibn Ibrahim has narrated from his father from Hammad from Hariz, from Muhammad ibn Muslim who has said the following: “I once asked one of the two Imam, (abu Ja’far or abu ‘Abd Allah), ‘Alayhim al-Salam, about one’s wearing different kinds of clothes in the state of Ihram, if needed. He (the Imam) said, ‘For wearing every kind there is ransom to pay.’”
