بَابُ الْقِمَارِ وَ النُّهْبَةِ

عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ سَيْفِ بْنِ عَمِيرَةَ عَنْ زِيَادِ بْنِ عِيسَى وَ هُوَ أَبُو عُبَيْدَةَ الْحَذَّاءُ قَالَ:

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنْ قَوْلِ اللَّهِ عَزَّ وَ جَلَّ- وَ لا تَأْكُلُوا أَمْوالَكُمْ بَيْنَكُمْ بِالْباطِلِ‌ فَقَالَ كَانَتْ قُرَيْشٌ تُقَامِرُ الرَّجُلَ بِأَهْلِهِ وَ مَالِهِ فَنَهَاهُمُ اللَّهُ عَزَّ وَ جَلَّ عَنْ ذَلِكَ.

1. A number of our people have narrated from Ali ibn al-Hakam from Sayf ibn ‘Amirah from Ziyad ibn ‘Isa and he is abu ‘Ubaydah al- Hadhdha’ who has said the following: “This is concerning my question before abu ‘ Abd Allah (a.s.), about the words of Allah, most Majestic, most Glorious, ‘You must not consume your assets in invalid dealings among your selves. . . (2:184) He (the Imam) said, ‘Among Quraysh a man gambled even his wife and property. Allah, most Majestic, most Glorious, prohibited such dealings.’”

أَبُو عَلِيٍّ الْأَشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ عَنْ أَحْمَدَ بْنِ النَّضْرِ عَنْ عَمْرِو بْنِ شِمْرٍ عَنْ جَابِرٍ عَنْ أَبِي جَعْفَرٍ ع قَالَ:

لَمَّا أَنْزَلَ اللَّهُ عَزَّ وَ جَلَّ عَلَى رَسُولِ اللَّهِ ص‌ - إِنَّمَا الْخَمْرُ وَ الْمَيْسِرُ وَ الْأَنْصابُ وَ الْأَزْلامُ رِجْسٌ مِنْ عَمَلِ الشَّيْطانِ فَاجْتَنِبُوهُ‌ قِيلَ يَا رَسُولَ اللَّهِ مَا الْمَيْسِرُ فَقَالَ كُلُّ مَا تُقُومِرَ بِهِ حَتَّى الْكِعَابُ وَ الْجَوْزُ قِيلَ فَمَا الْأَنْصَابُ قَالَ مَا ذَبَحُوهُ لآِلِهَتِهِمْ قِيلَ فَمَا الْأَزْلَامُ قَالَ قِدَاحُهُمُ الَّتِي يَسْتَقْسِمُونَ بِهَا.

2. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Ahmad ibn al-Nadr from ‘Amr ibn Shamir from Jabir who has said the following: “Abu Ja‘far (a.s.), has said that when Allah, most Majestic, most Glorious, sent to His Messenger, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, the following verse, ‘Wine, gambling, idols and gambling arrows are of the filthy deeds of Satan, you must avoid them’ (5:93), it was asked, ‘O Messenger of Allah, what is al-Maysir?’ The Messenger of Allah replied, ‘It is everything with which gambling is conducted, like cubes and walnuts and so on.’ It then was asked, ‘What is al-Ansab?’ The Messenger of Allah replied, ‘It is what they slaughter for their gods.’ It then was asked, ‘What is al-Azlam?’ The Messenger of Allah replied, ‘It is the arrows that they used to distribute certain items.’”

بَعَثَ أَبُو الْحَسَنِ ع غُلَاماً يَشْتَرِي لَهُ بَيْضاً فَأَخَذَ الْغُلَامُ بَيْضَةً أَوْ بَيْضَتَيْنِ فَقَامَرَ بِهَا فَلَمَّا أَتَى بِهِ أَكَلَهُ فَقَالَ لَهُ مَوْلًى لَهُ إِنَّ فِيهِ مِنَ الْقِمَارِ قَالَ فَدَعَا بِطَشْتٍ فَتَقَيَّأَهُ.

3. A number of our people have narrated from Sahl ibn Ziyad Ahmad ibn Muhammad from Ahmad ibn Muhammad from all from ibn Mahbub from Yunus ibn Ya’qub from ‘Abd al-Hamid ibn Sa‘id who has said the following: “Once, abu al-Hassan ‘Alayhi al-Salam, sent one of the slaves to buy eggs for him. The slave took one or two eggs and gambled with them. When the slave came back he (the Imam) used the eggs for food. A servant told him (the Imam) about gambling. He (the Imam) asked for a washbowl and threw up.”

مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ الْحُسَيْنِ عَنْ مُحَمَّدِ بْنِ سِنَانٍ عَنْ أَبِي الْجَارُودِ قَالَ

سَمِعْتُ أَبَا جَعْفَرٍ ع يَقُولُ قَالَ رَسُولُ اللَّهِ ص‌ لَا يَزْنِي الزَّانِي حِينَ يَزْنِي وَ هُوَ مُؤْمِنٌ وَ لَا يَسْرِقُ السَّارِقُ حِينَ يَسْرِقُ وَ هُوَ مُؤْمِنٌ وَ لَا يَنْهَبُ نُهْبَةً ذَاتَ شَرَفٍ‌ حِينَ يَنْهَبُهَا وَ هُوَ مُؤْمِنٌ قَالَ ابْنُ سِنَانٍ قُلْتُ لِأَبِي الْجَارُودِ وَ مَا نُهْبَةٌ ذَاتُ شَرَفٍ قَالَ نَحْوُ مَا صَنَعَ حَاتِمٌ حِينَ قَالَ مَنْ أَخَذَ شَيْئاً فَهُوَ لَهُ.

4. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Muhammad ibn Sinan from abu al-Jarud who has said the following: “I once heard abu Ja‘far (a.s.), saying, ‘The Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has said, ‘A fornicator does not fornicate while he is a believing person, a thief does not steal while he is a believing person and an honorable person does not do Nahbah Dhata Sharaf (an honor-loot) while he is a believing person.’ Ibn Sinan has said that I then asked abu al-Jarud, ‘What is a ‘Nahbah Dhata Sharaf’?’ He replied, ‘It is like what Hatim did when he said, “Whoever takes something it is his.’””

5. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Safwan from al-‘Ala’ from Muhammad ibn Muslim who has said the following: “One of the two Imam, (abu Ja’far or abu ‘Abd Allah), ‘Alayhim al-Salam, has said, ‘Gambling and plundering are not righteous deeds.’”

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ النَّوْفَلِيِّ عَنِ السَّكُونِيِّ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ:

كَانَ يَنْهَى عَنِ الْجَوْزِ يَجِي‌ءُ بِهِ الصِّبْيَانُ مِنَ الْقِمَارِ أَنْ يُؤْكَلَ وَ قَالَ هُوَ سُحْتٌ.

6. Ali ibn Ibrahim has narrated from his father from al-Nawfaliy from al-Sakuniy who has said the following: “Abu ‘Abd Allah (a.s.), would prohibit utilization of walnuts, that children bring after using in gambling, saying that it is Suht (filthy), unlawful.’”

مُحَمَّدُ بْنُ يَحْيَى عَنِ الْعَمْرَكِيِّ بْنِ عَلِيٍّ عَنْ عَلِيِّ بْنِ جَعْفَرٍ عَنْ أَخِيهِ أَبِي الْحَسَنِ ع قَالَ:

سَأَلْتُهُ عَنِ النُّثَارِ مِنَ السُّكَّرِ وَ اللَّوْزِ وَ أَشْبَاهِهِ أَ يَحِلُّ أَكْلُهُ قَالَ يُكْرَهُ أَكْلُ مَا انْتُهِبَ‌.

7. Muhammad ibn Yahya has narrated from al-‘Amrakiy ibn Ali from Ali ibn Ja’far from his brother who has said the following: “I once asked abu al-Hassan (a.s.), about the case of what is spread of sugar, almond and so on, on happy occasions if is permissible. He (the Imam) said, ’It is detestable to consume what is plundered.’”

8. A number of our people have narrated from Ahmad ibn abu ‘Abd Allah from Muhammad ibn Ali from ‘Abd Allah ibn Jamilah from Ishaq ibn ‘Ammar who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about what people scatter on certain people during an entertaining occasion or wedding ceremony. He (the Imam) said, ‘It is unlawful but what they give, you can take it.’”

10. Al-Husayn from Muhammad has narrated from Muhammad ibn Ahmad al-Nahdiy from Ya’qub ibn Yazid from ‘Abd Allah ibn Jabalah from Ishaq ibn ‘Ammar who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of children who play with walnuts and eggs and gamble. He (the Imam) said, ‘You must not consume them for food; it is unlawful.’”
