بَابُ النَّظَرِ لِمَنْ أَرَادَ التَّزْوِيجَ‌

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ أَبِي أَيُّوبَ الْخَزَّازِ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ:

سَأَلْتُ أَبَا جَعْفَرٍ ع- عَنِ الرَّجُلِ يُرِيدُ أَنْ يَتَزَوَّجَ الْمَرْأَةَ أَ يَنْظُرُ إِلَيْهَا قَالَ نَعَمْ إِنَّمَا يَشْتَرِيهَا بِأَغْلَى الثَّمَنِ‌.

1. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from abu Ayyub af-Khazzaz from Muhammad ibn Muslim who has said the following: “I once asked abu Ja‘far (a.s.), about the case of a man who wanted to marry a woman if he could look at her. He (the Imam) said, ‘Yes, he can do so because he wants to pay a high price/”

[1]اجمع العلماء كافة على أن من أراد نكاح امرأة يجوز له النظر الى وجهها و كفيها من مفصل الزند و اختلفوا فيما عدا ذلك فقال بعضهم يجوز النظر الى شعرها و محاسنها أيضا و اشترط الاكثر العلم بصلاحيتها للتزويج و احتمال اجابتها و ان لا يكون لريبة و المراد بها خوف الوقوع بها في محرم و ان الباعث على النظر إرادة التزويج دون العكس و المستفاد من النصوص الاكتفاء بقصد التزويج قبل النظر كيف كان.( آت)ص 365

عَنْهُ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ هِشَامِ بْنِ سَالِمٍ وَ حَمَّادِ بْنِ عُثْمَانَ وَ حَفْصِ بْنِ الْبَخْتَرِيِّ كُلِّهِمْ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ:

لَا بَأْسَ بِأَنْ يَنْظُرَ إِلَى وَجْهِهَا وَ مَعَاصِمِهَا إِذَا أَرَادَ أَنْ يَتَزَوَّجَهَا.

2. It is narrated from the narrator of the previous Hadith from Ibn Abi ‘Umayr from Hisham ibn Salim and Hammad ibn ‘Uthman and Hafs ibn al-Bakhtariy all have said the following: “Abu ‘Abd Allah (a.s.), has said, ‘It is not unlawful for a man to look at her face and hands to wrists, if he wants to marry her.’”

أَبُو عَلِيٍّ الْأَشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ عَنْ صَفْوَانَ عَنِ ابْنِ مُسْكَانَ عَنِ الْحَسَنِ بْنِ السَّرِيِّ قَالَ:

قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع الرَّجُلُ يُرِيدُ أَنْ يَتَزَوَّجَ الْمَرْأَةَ يَتَأَمَّلُهَا وَ يَنْظُرُ إِلَى خَلْفِهَا وَ إِلَى وَجْهِهَا قَالَ نَعَمْ لَا بَأْسَ بِأَنْ يَنْظُرَ الرَّجُلُ إِلَى الْمَرْأَةِ إِذَا أَرَادَ أَنْ يَتَزَوَّجَهَا يَنْظُرَ إِلَى خَلْفِهَا وَ إِلَى وَجْهِهَا.

3. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan from ibn Muskan from al-Hassan ibn al-Sariy who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man who wants to marry a woman; if he can think about her, look behind her and to her face. He (the Imam) said, ‘Yes, it is lawful for a man to look at the woman, if he wants to marry, behind her and to her face/”

الْحُسَيْنُ بْنُ مُحَمَّدٍ عَنْ مُعَلَّى بْنِ مُحَمَّدٍ عَنْ بَعْضِ أَصْحَابِنَا عَنْ أَبَانِ بْنِ عُثْمَانَ عَنِ الْحَسَنِ بْنِ السَّرِيِّ عَنْ أَبِي عَبْدِ اللَّهِ ع

أَنَّهُ سَأَلَهُ عَنِ الرَّجُلِ يَنْظُرُ إِلَى الْمَرْأَةِ قَبْلَ أَنْ يَتَزَوَّجَهَا قَالَ نَعَمْ فَلِمَ يُعْطِي مَالَهُ.

4. Al-Husayn from Muhammad has narrated from Mu’alla’ ibn Muhammad from certain persons of our people from Aban ibn ‘Uthman from al-Hassan al-Sariy who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man who looks at a woman before he marries her. He (the Imam) said, ‘Yes, he can do so; then what for he gives his assets?’”

عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ خَالِدٍ عَنْ أَبِيهِ عَنْ عَبْدِ اللَّهِ بْنِ الْفَضْلِ عَنْ أَبِيهِ عَنْ رَجُلٍ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ:

قُلْتُ لَهُ أَ يَنْظُرُ الرَّجُلُ إِلَى الْمَرْأَةِ يُرِيدُ تَزْوِيجَهَا فَيَنْظُرُ إِلَى شَعْرِهَا وَ مَحَاسِنِهَا قَالَ لَا بَأْسَ بِذَلِكَ إِذَا لَمْ يَكُنْ مُتَلَذِّذاً.

5. A number of our people have narrated from Ahmad ibn Muhammad from ibn Khalid from his father from ‘Abd Allah ibn al-Fadl from a man who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man who wants to marry a woman; if he can look to her hairs and beauty. He (the Imam) said, ‘It is lawful if it is not with lust.’”
