بَابُ نِكَاحِ الْقَابِلَةِ

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ خَلَّادٍ السِّنْدِيِّ عَنْ عَمْرِو بْنِ شِمْرٍ [عَنْ جَابِرٍ] عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ:

قُلْتُ لَهُ الرَّجُلُ يَتَزَوَّجُ قَابِلَتَهُ قَالَ لَا وَ لَا ابْنَتَهَا.

1. Ali ibn Ibrahim has narrated from his father from ibn abu ‘ Umayr from Khalfad af-Sindiy from “Amr ibn Shamir from (Jabir) who has said the following: “This is concerning my question before abu ‘ Abd Allah (a.s.), if one can marry his al- Qabilah (special nurse who helps one’s mother during her giving birth and thereafter). He (the Imam) said, ‘No, and not her daughter also.’”

مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ أَحْمَدَ عَنْ مُحَمَّدِ بْنِ عِيسَى عَنْ أَبِي مُحَمَّدٍ الْأَنْصَارِيِّ عَنْ عَمْرِو بْنِ شِمْرٍ عَنْ جَابِرِ بْنِ يَزِيدَ قَالَ:

سَأَلْتُ أَبَا جَعْفَرٍ ع- عَنِ الْقَابِلَةِ أَ يَحِلُّ لِلْمَوْلُودِ أَنْ‌ يَنْكِحَهَا فَقَالَ لَا وَ لَا ابْنَتَهَا هِيَ بَعْضُ أُمَّهَاتِهِ. وَ - فِي رِوَايَةِ مُعَاوِيَةَ بْنِ عَمَّارٍ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ: قَالَ إِنْ قَبِلَتْ وَ مَرَّتْ فَالْقَوَابِلُ أَكْثَرُ مِنْ ذَلِكَ وَ إِنْ قَبِلَتْ وَ رَبَّتْ حَرُمَتْ عَلَيْهِ.

2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa from abu Muhammad al-Ansariy from “Amr ibn Shamir from Jabir ibn Yazid who has said the following: “This is concerning my question before abu Ja‘far (a.s.), about al-Qabilah (special nurse who helps one’s mother during her giving birth and thereafter); if the child can marry her. He (the Imam) said, ‘No, not her daughter also, because she is one of his mothers.’ Mu‘awiyah ibn ‘Ammar has narrated the following: “Abu ‘Abd Allah (a.s.), has said, ‘If she just helps to give birth and moves on, then such nurses are many; but if she helps during birth, and brings him up, then she is unlawful for marriage.’”

حُمَيْدُ بْنُ زِيَادٍ عَنْ عَبْدِ اللَّهِ بْنِ أَحْمَدَ عَنْ عَلِيِّ بْنِ الْحَسَنِ عَنْ مُحَمَّدِ بْنِ زِيَادِ بْنِ عِيسَى بَيَّاعِ السَّابِرِيِّ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ إِبْرَاهِيمَ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ:

إِذَا اسْتَقْبَلَ الصَّبِيُّ الْقَابِلَةَ بِوَجْهِهِ حَرُمَتْ عَلَيْهِ وَ حَرُمَ عَلَيْهِ وَلَدُهَا.

3. Humayd ibn Ziyad has narrated from ‘Abd Allah ibn Ahmad from Ali ibn al-Hassan from Muhammad ibn Ziyad ibn ‘Isa Bayya’ al- Sabiriy from Aban ibn ‘Uthman from Ibrahim who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘If the child feels compassion toward al-Qabilah (special nurse who helps one’s mother during her giving birth and thereafter) she becomes unlawful to him for marriage as well as her children.’”

[1]كل من النهى و التحريم محمول على الكراهة عند الاصحاب جمعا بينها و بين ما دل صريحا على الحل و فسر بعضهم هذا الحديث بان المراد بالاستقبال هو الميل القلبى و هو لا يحصل الا بالتربية كما إذا رأى الصبى قابلته حن.( كذا في هامش المطبوع).ص 448
