بَابُ الْأَجِنَّةِ الَّتِي تَخْرُجُ مِنْ بُطُونِ الذَّبَائِحِ‌

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ عُمَرَ بْنِ أُذَيْنَةَ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ:

سَأَلْتُ أَحَدَهُمَا ع عَنْ قَوْلِ اللَّهِ عَزَّ وَ جَلَّ- أُحِلَّتْ لَكُمْ بَهِيمَةُ الْأَنْعامِ‌ فَقَالَ الْجَنِينُ فِي بَطْنِ أُمِّهِ إِذَا أَشْعَرَ وَ أَوْبَرَ فَذَكَاتُهُ ذَكَاةُ أُمِّهِ فَذَلِكَ الَّذِي عَنَى اللَّهُ عَزَّ وَ جَلَّ.

1. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from ‘Umar ibn ‘Udhaynah from Muhammad ibn Muslim who has said the following: “I once asked one of the two Imam, (abu Ja‘far or abu ‘Abd Allah), ‘Alayhim al-Salam, about the words of Allah, most Majestic, most Glorious, ‘He has made lawful for you the pitch-black animals for food.’ (5:2) He (the Imam) said, ‘It means the young in the womb of the mother when it grows hair or wool, thus, proper slaughtering for it is the proper slaughtering of the mother and that is to which the words of Allah refer.”’

إِذَا ذَبَحْتَ الذَّبِيحَةَ فَوَجَدْتَ فِي بَطْنِهَا وَلَداً تَامّاً فَكُلْ وَ إِنْ لَمْ يَكُنْ تَامّاً فَلَا تَأْكُلْ.

2. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘If you slaughter an animal and find inside its young in a complete form, you can use it for food but if it is not complete then do not use it for food.’”

أَبُو عَلِيٍّ الْأَشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ عَنْ مُحَمَّدِ بْنِ إِسْمَاعِيلَ عَنْ عَلِيِّ بْنِ النُّعْمَانِ عَنْ يَعْقُوبَ بْنِ شُعَيْبٍ قَالَ:

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ الْحُوَارِ تُذَكَّى أُمُّهُ أَ يُؤْكَلُ بِذَكَاتِهَا فَقَالَ إِذَا كَانَ تَمَاماً وَ نَبَتَ عَلَيْهِ الشَّعْرُ فَكُلْ. - عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ عَنْ دَاوُدَ بْنِ‌ الْحُصَيْنِ عَنْ يَعْقُوبَ بْنِ شُعَيْبٍ عَنْ أَبِي عَبْدِ اللَّهِ ع‌ مِثْلَهُ.

3. Abu Ali al-Ash‘ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Muhammad ibn ’Isma‘il from Ali ibn al-Nu’man from Ya‘qub ibn who has said the following: “I once asked abu ‘Abd Allah, ‘Alayhi al-Salam, about the young of camel when the mother is slaughtered; if it can also be used for food because its mother is slaughtered. He (the Imam) said, ‘If it is formed completely and hairs or its fur has grown, then you can use it for food.’” A number of our people have narrated from Sahl ibn Ziyad from Ahmad ibn Muhammad ibn abu Nasr from Dawud ibn al-Haseen from Ya‘qub ibn Shu’ayb from abu ‘Abd Allah, ‘Alayhi al-Salam, a similar Hadith.

عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ خَالِدٍ عَنْ عُثْمَانَ بْنِ عِيسَى عَنْ سَمَاعَةَ قَالَ:

سَأَلْتُهُ عَنِ الشَّاةِ يَذْبَحُهَا وَ فِي بَطْنِهَا وَلَدٌ وَ قَدْ أَشْعَرَ فَقَالَ ع ذَكَاتُهُ ذَكَاةُ أُمِّهِ.

4. A number of our people have narrated from Ahmad ibn Muhammad ibn Khalid from ‘Uthman ibn ‘Isa from Sama‘ah who has said the following: “I once asked him (the Imam) (a.s.), about a sheep which is slaughtered and its young, which has grown its wool, is found inside. He (the Imam) said, ‘Slaughtering for it is the slaughtering of its mother.’”

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ هَارُونَ بْنِ مُسْلِمٍ عَنْ مَسْعَدَةَ بْنِ صَدَقَةَ عَنْ أَبِي عَبْدِ اللَّهِ ع أَنَّهُ قَالَ:

فِي الْجَنِينِ إِذَا أَشْعَرَ فَكُلْ وَ إِلَّا فَلَا تَأْكُلْ. يَعْنِي إِذَا لَمْ يُشْعِرْ.

5. Ali ibn Ibrahim has narrated from (his father) from Harun ibn Muslim from Mas’adah ibn Sadaqah who has said the following: “About the case of a young found inside an animal which is slaughtered, abu ‘Abd Allah (a.s.), has said, ‘You can use it for food if it has grown hairs, otherwise, do not use it for food, that is, if it has not grown any hairs.’”
