بَابُ الرَّجُلِ يُصَلِّي بِالْقَوْمِ وَ هُوَ عَلَى غَيْرِ طُهْرٍ أَوْ لِغَيْرِ الْقِبْلَةِ

عَلِيُّ بْنُ إِبْرَاهِيمَ بْنِ هَاشِمٍ عَنْ أَبِيهِ وَ مُحَمَّدُ بْنُ إِسْمَاعِيلَ عَنِ الْفَضْلِ بْنِ شَاذَانَ جَمِيعاً عَنْ حَمَّادِ بْنِ عِيسَى عَنْ حَرِيزٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ:

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ الرَّجُلِ أَمَّ قَوْماً وَ هُوَ عَلَى غَيْرِ طُهْرٍ فَأَعْلَمَهُمْ بَعْدَ مَا صَلَّوْا فَقَالَ يُعِيدُ هُوَ وَ لَا يُعِيدُونَ.

1. Ali ibn Ibrahim ibn Hashim has narrated from his father and Muhammad ibn ’Isma‘il from al-Fadl ibn Shadhan all from Hammad ibn ‘Isa from Hariz Muhammad ibn Muslim who has said the following: “I once asked abu ’Abd Allah (a.s.), about a man who leads a people in Salah (prayer) but does not have a valid Wudu’ and informs them after Salah (prayer). He (the Imam) said, ‘Only he, but not they, must perform again.”’

عَلِيٌّ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادٍ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللَّهِ ع‌ فِي الْأَعْمَى يَؤُمُّ الْقَوْمَ وَ هُوَ عَلَى غَيْرِ الْقِبْلَةِ قَالَ

يُعِيدُ وَ لَا يُعِيدُونَ فَإِنَّهُمْ قَدْ تَحَرَّوْا.

2. Ali has narrated from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “I once asked abu ‘Abd Allah (a.s.), about a blind man who leads a people in Salah (prayer) and is not facing al-Qiblah (al-Ka‘bah). He (the Imam) said, ‘Only he, but not they, performs again; they had made the effort (about al-Qiblah (al-Ka‘bah)).’”

مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ حَدِيدٍ عَنْ جَمِيلٍ عَنْ زُرَارَةَ قَالَ:

سَأَلْتُ أَحَدَهُمَا ع عَنْ رَجُلٍ صَلَّى بِقَوْمٍ رَكْعَتَيْنِ فَأَخْبَرَهُمْ أَنَّهُ لَمْ يَكُنْ عَلَى وُضُوءٍ قَالَ يُتِمُّ الْقَوْمُ صَلَاتَهُمْ فَإِنَّهُ لَيْسَ عَلَى الْإِمَامِ ضَمَانٌ‌.

3. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn Hadid from Jamil from Zurarah who has said the following: “I once asked one of the two Imam, ‘Alayhim al-Salam, about a man who leads a people in Salah (prayer) of two Rak‘at and then informs them that he does not have a valid Wudu’. He (the Imam) said, ‘People must complete their Salah (prayer); there is no responsibility on Imam.’”

[3]اذ لو كان عليه ضمان كانت صلاتهم تابعة لصلاته فتبطل ببطلانها و ما قيل من أن المراد لا يضمن اتمام صلاتهم فلا يخفى ما فيه من البعد و المشهور عدم الإعادة فيما إذا علم فسق الامام أو كفره أو كونه على غير طهارة بعد الصلاة و كذا في الاثناء و نقل عن المرتضى و ابن الجنيد انهما اوجبا الإعادة و حكى عن الصدوق في الفقيه عن بعض مشايخه أنّه سمعهم يقولون: ليس عليهم إعادة شي‌ء مما جهر فيه و عليهم إعادة ما صلى بهم ممّا لم يجهر فيه.( آت)ص 378

فِي قَوْمٍ خَرَجُوا مِنْ خُرَاسَانَ أَوْ بَعْضِ الْجِبَالِ وَ كَانَ يَؤُمُّهُمْ رَجُلٌ فَلَمَّا صَارُوا إِلَى الْكُوفَةِ عَلِمُوا أَنَّهُ يَهُودِيٌّ قَالَ لَا يُعِيدُونَ.

4. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from certain persons of his people who has said the following: “About the case of a people who traveled from certain mountainous area of Khurasan and a man would lead them in Salah (prayer), when in al-Kufah they found out that he was a Jew, Abu ‘Abd Allah (a.s.), has said, ‘They are not required to perform their Salah (prayer) again.’”
