[١]كذا في جميع نسخ الفقيه و بعض نسخ الكافي، و المعنى أن للمطلوب حقّ الآباء لرجوع الضمير الى المرجع الأقرب و كذا اسم الإشارة حيث كان للقريب. و في التهذيبين« ذلك له» و حيث كان للبعيد فالاشارة الى الطلب و الضمير للطالب.
[٢]قال الشيخ- رحمه اللّه- ظنّ أبو جعفر- رحمه اللّه- أنهما متنافيان و ليس-- الامر على ما ظنّ، لان قوله عليه السلام« ذلك له» ليس في صريحه أن ذلك للطالب الذي طلب الاستبداد بنصف التركة، و ليس يمتنع أن يكون المراد بقوله« ذلك له» يعنى الذي أبى على صاحبه الانقياد الى ما يريده فيكون تلخيص الكلام أن له أن يأبى عليه و لا يجيب مسألته و على هذا الوجه لا تنافى بينهما على حال. و قال صاحب الوافي: و ظنّ صاحب الاستبصار أنه لو لا تفسيره للحديث بما فسره لكانا متنافيين و ليس الامر على ما ظنّ لان حديث الصفار ليس نصا على المنع من الانفراد لجواز أن يكون معناه أنّه ليس عليهما الا انفاذ وصاياه على ما أمرهما و أن لا يخالفا فيها أمره تفرّدا أو اجتمعا، أو يكون معناه أنّه ان نص على الاجتماع وجب الاجتماع، و ان جوز الانفراد جاز الانفراد، و بالجملة انما الواجب عليهما أن لا يخالفاه الا أن ما ذكره في الاستبصار هو الأحسن و الأوفق و الاصوب. أقول: المشهور بين الاصحاب كما في- المرآة أنّه لو أوصى الى اثنين و شرط اجتماعهما أو أطلق فلا يجوز لأحدهما التصرّف بدون اذن صاحبه، و ذهب الشيخ في أحد قوليه و من تبعه الى جواز انفراد كل منهما مع الإطلاق.

سَمِعْتُ أَبَا عَبْدِ اللَّهِ ع يَقُولُ مَنْ قَتَلَ نَفْسَهُ مُتَعَمِّداً فَهُوَ فِي نَارِ جَهَنَّمَ خالِداً فِيها قِيلَ لَهُ أَ رَأَيْتَ إِنْ كَانَ أَوْصَى بِوَصِيَّةٍ ثُمَّ قَتَلَ نَفْسَهُ مُتَعَمِّداً مِنْ سَاعَتِهِ تُنْفَذُ وَصِيَّتُهُ قَالَ إِنْ كَانَ أَوْصَى قَبْلَ أَنْ يُحْدِثَ حَدَثاً فِي نَفْسِهِ مِنْ جِرَاحَةٍ أَوْ فِعْلٍ أُجِيزَتْ وَصِيَّتُهُ فِي ثُلُثِهِ وَ إِنْ كَانَ أَوْصَى بِوَصِيَّةٍ وَ قَدْ أَحْدَثَ فِي نَفْسِهِ جِرَاحَةً أَوْ فِعْلًا لَعَلَّهُ يَمُوتُ لَمْ تُجَزْ وَصِيَّتُهُ.
Hadith.5470 - Al-Hasan ibn Mahbub narrated from Abu Walad, who said: I heard Abu Abdullah Imam Jafar ibn Muhammad Al-Sadiq (as) say: "Whoever intentionally kills himself will be in the Fire of Hell, abiding therein forever." Imam (as) was asked: "What if he had made a will (waṣiyyah) and then deliberately killed himself immediately after? Will his will be carried out?" Imam (as) replied: "If he made the will before committing any harmful act against himself, whether by injury or any other action, then his will is valid regarding one-third of his wealth. However, if he made the will after having already harmed himself - by injuring himself or committing an act intending death - then his will is not valid."

كَتَبَ مُحَمَّدُ بْنُ اَلْحَسَنِ اَلصَّفَّارُ رَضِيَ اَللَّهُ عَنْهُ إِلَى أَبِي مُحَمَّدٍ اَلْحَسَنِ بْنِ عَلِيٍّ عَلَيْهِ اَلسَّلاَمُ : رَجُلٌ أَوْصَى إِلَى رَجُلَيْنِ أَ يَجُوزُ لِأَحَدِهِمَا أَنْ يَنْفَرِدَ بِنِصْفِ اَلتَّرِكَةِ وَ اَلْآخَرِ بِالنِّصْفِ فَوَقَّعَ عَلَيْهِ اَلسَّلاَمُ "لاَ يَنْبَغِي لَهُمَا أَنْ يُخَالِفَا اَلْمَيِّتَ وَ يَعْمَلاَنِ عَلَى حَسَبِ مَا أَمَرَهُمَا إِنْ شَاءَ اَللَّهُ".
Hadith.5471 - Muhammad ibn Al-Hasan Al-Ṣaffar (may Allah (swt) be pleased with him) wrote to Abu Muhammad Imam Hasan ibn Ali Al-Askari (as) asking: "A man appointed two individuals as executors of his will. Is it permissible for one of them to independently handle half of the inheritance and the other to manage the other half?" Imam (as) responded in writing: "It is not appropriate for them to act contrary to the deceased's instructions. They should act according to what he commanded them, God willing."

أَحَدُهُمَا لِصَاحِبِهِ خُذْ نِصْفَ مَا تَرَكَ وَ أَعْطِنِي النِّصْفَ مِمَّا تَرَكَ فَأَبَى عَلَيْهِ الْآخَرُ فَسَأَلُوا أَبَا عَبْدِ اللَّهِ ع عَنْ ذَلِكَ فَقَالَ ذَاكَ لَهُ.
Hadith.5472 - In the book of Muhammad ibn Yaʿqub Al-Kulayni (may Allah (swt) have mercy on him), narrated from Ahmad ibn Muhammad, from Ali ibn Al-Hasan Al-Mithami, from his two brothers Muhammad and Ahmad, from their father, from Dawud ibn Abi Yazid, from Burayd ibn Muawiyah, it is reported: A man passed away and appointed two individuals as executors of his will. One of them said to his companion, "Take half of what he left behind, and give me the other half." However, the other refused. They sought guidance from Abu Abdullah (as) regarding this matter, and Imam (as) said: "That rightfully belongs to him."
