فَقَالَ قَدْ تُفْتَقُ الْبِكْرُ مِنَ الْمَرْكَبِ وَ مِنَ النَّزْوَةِ[1].
“About the case of a man who marries a woman as a virgin but finds that she is not virgin; if it is permissible to live with her, abu al-Hassan has said, ‘At certain times it is torn because of riding or jumping.’”
كَتَبْتُ إِلَى أَبِي الْحَسَنِ ع أَسْأَلُهُ عَنْ رَجُلٍ تَزَوَّجَ جَارِيَةً بِكْراً فَوَجَدَهَا ثَيِّباً هَلْ يَجِبُ لَهَا الصَّدَاقُ وَافِياً أَمْ يُنْتَقَصُ قَالَ يُنْتَقَصُ.
“I once wrote to abu al-Hassan (a.s.), and asked about the case of a man who married a virgin girl but found out that she was not virgin if it was obligatory to pay complete mahr (dower) or less. He (the Imam) answered, ‘It is less.’”
