9. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy from Muhammad ibn Muslim who has said the following: “About the case of a man who goes through the process of al-Li‘an (condemnation) against his wife who is speechless, abu ‘Abd Allah (a.s.), has said, ‘They must be separated from each other.”’

[2]« لا يجلد» ذكره في المسالك و فيه بدله« لا يحل له» ثم قال في الاستدلال على عدم الحد إنّه لو كان الحدّ باقيا لذكره و الا لتأخر البيان عن وقت الخطاب ثمّ قال: و عليه عمل الشيخ و المحقق و العلامة في أحد قوليه و خالف في ذلك المفيد و العلامة في القواعد و اختاره الشهيد الثاني- رحمه اللّه- و الأول أقوى.( آت)ص 164
