سُئِلَ أَبُو عَبْدِ اللَّهِ ع عَنْ رَجُلٍ قَذَفَ امْرَأَتَهُ بِالزِّنَى وَ هِيَ خَرْسَاءُ صَمَّاءُ لَا تَسْمَعُ مَا قَالَ قَالَ إِنْ كَانَ لَهَا بَيِّنَةٌ فَشَهِدُوا عِنْدَ الْإِمَامِ جُلِدَ الْحَدَّ وَ فُرِّقَ بَيْنَهُمَا ثُمَّ لَا تَحِلُّ لَهُ أَبَداً وَ إِنْ لَمْ تَكُنْ بَيِّنَةٌ فَهِيَ حَرَامٌ عَلَيْهِ مَا أَقَامَ مَعَهَا وَ لَا إِثْمَ عَلَيْهَا مِنْهُ‌[2].

قَالَ أَمِيرُ الْمُؤْمِنِينَ ع‌ إِذَا كَانَتِ الْحُرَّةُ تَحْتَ الْعَبْدِ فَالطَّلَاقُ وَ الْعِدَّةُ بِالنِّسَاءِ يَعْنِي تَطْلِيقَهَا ثَلَاثاً وَ تَعْتَدُّ ثَلَاثَ حِيَضٍ.
