سَأَلْتُهُ عَنْ رَجُلٍ حُرٍّ كَانَتْ تَحْتَهُ أَمَةٌ فَطَلَّقَهَا طَلَاقاً بَائِناً ثُمَّ اشْتَرَاهَا هَلْ يَحِلُّ لَهُ أَنْ يَطَأَهَا قَالَ لَا. - قَالَ ابْنُ أَبِي عُمَيْرٍ وَ فِي حَدِيثٍ آخَرَ حَلَّ لَهُ فَرْجُهَا مِنْ أَجْلِ شِرَائِهَا وَ الْحُرُّ وَ الْعَبْدُ فِي ذَلِكَ سَوَاءٌ

Ali, from his father, from Ibn Abu Umeyr, from Hammad, from Al Halby, (It has been narrated) from Abu Abdullah asws , said, ‘I asked him asws about a free man who had a slave girl under him. So he divorced her with an irrevocable divorce, then bought her. Is it Permissible for him that he copulates with her?’ He asws said: ‘No’.
