سَأَلْتُهُ عَنْ رَجُلٍ أَعْتَقَ نِصْفَ جَارِيَتِهِ ثُمَّ قَذَفَهَا بِالزِّنَى قَالَ فَقَالَ أَرَى عَلَيْهِ خَمْسِينَ جَلْدَةً وَ يَسْتَغْفِرَ اللَّهَ عَزَّ وَ جَلَّ مِنْ فِعْلِهِ قُلْتُ أَ رَأَيْتَ إِنْ جَعَلَتْهُ فِي حِلٍّ مِنْ قَذْفِهِ إِيَّاهَا وَ عَفَتْ عَنْهُ قَالَ لَا ضَرْبَ عَلَيْهِ إِذَا عَفَتْ عَنْهُ مِنْ قَبْلِ أَنْ تَرْفَعَهُ.

Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ibn Mahboub, from Hisham Bin Salim, from Hamza Bin Humran, (It has been narrated) from one of the two (5 th or 6 th Imam asws ), said, ‘I asked him asws about a man who emancipated (librated) half of his slave girl, then accused her with the adultery. So he asws said: ‘I asws view upon him being fifty lashes, and he should repent to Allah azwj Mighty and Majestic for his deed’. I said, ‘What is your asws view of her having freed him from his accusation and forgiven him about it?’ He asws said: ‘There is no whipping upon him if she has forgiven him before it (the matter) is raised (before a judge)’.

[3]قال الشيخ- رحمه اللّه- في التهذيب هذا الخبر محمول على أنّه كان اعتق خمسة أثمانها لان بذلك يستحق خمسين جلدة فاما إذا كان النصف سواء فليس عليه أكثر من الأربعين لانه نصف الحد و يجوز أيضا أن يكون استحق الأربعين بما عتق منه و ما زاد على ذلك يكون التعزير لان من قذف عبدا يستحق التعزير.ص 208
