قَالَ: مَنْ أَقَرَّ عَلَى نَفْسِهِ عِنْدَ الْإِمَامِ بِحَقِّ أَحَدٍ مِنْ حُقُوقِ الْمُسْلِمِينَ فَلَيْسَ عَلَى الْإِمَامِ أَنْ يُقِيمَ عَلَيْهِ الْحَدَّ الَّذِي أَقَرَّ بِهِ عِنْدَهُ حَتَّى يَحْضُرَ صَاحِبُ حَقِّ الْحَدِّ أَوْ وَلِيُّهُ فَيَطْلُبَهُ بِحَقِّهِ.

Ibn Mahboub, from Abu Ayoub, from Al Fuzayl Bin Yasaar, (It has been narrated) from Abu Abdullah asws : ‘The one who accepts upon himself in the presence of the Imam asws with a right of someone from the rights of the Muslims, so it is not upon the Imam asws that he asws should established the Penalty ( Hadd ) upon him, the one who accepted with it in his asws presence, until the owner of the right is present, or his guardian, so he seeks his right’.
