مَنْ ضَرَبَ مَمْلُوكاً حَدّاً مِنَ الْحُدُودِ مِنْ غَيْرِ حَدٍّ أَوْجَبَهُ الْمَمْلُوكُ عَلَى نَفْسِهِ لَمْ يَكُنْ لِضَارِبِهِ كَفَّارَةٌ إِلَّا عِتْقُهُ.

Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ibn Mahboub, from Hisham Bin Salim, from Abu Baseer, (It has been narrated) from Abu Ja’far asws having said: ‘The one who whips an owned (slave), a Penalty ( Hadd ) from the Penalties, without a Penalty ( Hadd ) having been Obligated upon himself, there would not be an expiation except for his emancipation (libration)’.
