سُئِلَ عَنْ رَجُلٍ أَتَى رَجُلًا وَ هُوَ رَاقِدٌ فَلَمَّا صَارَ عَلَى ظَهْرِهِ أَيْقَنَ بِهِ- فَبَعَجَهُ بَعْجَةً فَقَتَلَهُ فَقَالَ لَا دِيَةَ لَهُ وَ لَا قَوَدَ.

Ali Bin Ibrahim, from his father, from Amro Bin Usman, from Al Husayn Bin Khalid, (It has been narrated) from Abu Abdullah asws ,said, ‘He asws was asked about a man who came to a man while he was asleep. So when he came to be upon his back, he woke up due to it, so he poked him with a knife, so he killed him’. So he asws said: ‘There is neither a wergild for him, nor a retaliation’.
