قُلْتُ لَهُ قَوْلُ اللَّهِ عَزَّ وَ جَلَ كُتِبَ عَلَيْكُمُ الْقِصاصُ فِي الْقَتْلى الْحُرُّ بِالْحُرِّ وَ الْعَبْدُ بِالْعَبْدِ وَ الْأُنْثى بِالْأُنْثى قَالَ فَقَالَ لَا يُقْتَلُ حُرٌّ بِعَبْدٍ وَ لَكِنْ يُضْرَبُ ضَرْباً شَدِيداً وَ يُغَرَّمُ ثَمَنَهُ دِيَةَ الْعَبْدِ.

Abu Ali Al Ashary, from Muhammad Bin Abdul Jabbar, from Safwan, from Ibn Muskan, from Abu Baseer, (It has been narrated) from one of the two (5 th or 6 th Imam asws ), said, ‘I said to him asws , ‘The Words of Allah azwj Mighty and Majestic [2:178] O you who believe! The retaliation is Prescribed for you in the matter of the slain, the free for the free, and the slave for the slave, and the female for the female . So he asws said: ‘The free would not be killed due to the slave, but he would be whipped with intense whipping, and would be fined his value as wergild for the slave’.
