Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ibn Mahboub, from Hisham Bin Salim, from Abu Baseer who said, ‘I asked Abu Ja’far asws about the ‘ Mudabbir ’ (slave promised freedom upon the death of his master), who killed a man deliberately. So he asws said: ‘He would be killed due to it’. I said, ‘So if he killed him in error?’ So he asws said: ‘He would be handed over to the guardians of the killed one, so he would happen to be a slave for them, if they so desire to they can sell him, and if they so desire to they can keep him, and it is not for them that they kill him’. Then he asws said: ‘O Abu Muhammad! The ‘ Mudabbir ’ is a slave’.
