سَأَلْتُهُ عَنِ السِّنِّ وَ الذِّرَاعِ يُكْسَرَانِ عَمْداً أَ لَهُمَا أَرْشٌ أَوْ قَوَدٌ فَقَالَ قَوَدٌ قَالَ قُلْتُ فَإِنْ أَضْعَفُوا الدِّيَةَ فَقَالَ إِنْ أَرْضَوْهُ بِمَا شَاءَ فَهُوَ لَهُ.

Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Al Husayn Bin Saeed, from Al Nazar Bin Suweud, from Aasim Bin Humeyd, from Abu Baseer, (The narrator) says, ‘I asked Abu Abdullah asws about the teeth and the arms which are both broken deliberately, is there a compensation for these two, or retaliation?’ So he asws said: ‘Retaliation’. I said, ‘So if they were to double the wergild?’ So he asws said: ‘If they please him with whatever he so desires to, so it is for him’.

[2]يدل على ثبوت القصاص في كسر العظم و لم يعمل به أحد الا أن يحمل على القطع مجازا و اما السن فحكموا بالقصاص فيه مع القلع و اما مع الكسر فاختلفوا فيه فذهب بعضهم الى ثبوته إذا أمكن استيفاء المثل بلا زيادة و لا صدع في الباقي و في الخبر حجة لهم( آت).ص 320
