فِي رَجُلٍ حَمَلَ مَتَاعاً عَلَى رَأْسِهِ فَأَصَابَ إِنْسَاناً فَمَاتَ أَوِ انْكَسَرَ مِنْهُ فَقَالَ هُوَ ضَامِنٌ.

A number of our companions, from Sahl Bin Ziyad, from Ibn Abu Nasr, from Dawood Bin Sirhan, (It has been narrated) from Abu Abdullah asws regarding a man who carried provisions upon his head, so they struck a human being and he died, or something broke from him. So he asws said: ‘He is responsible’.

[2]قال في المسالك: الرواية مع ضعفها مخالفة للقواعد لانه انما يضمن المصدوم في ماله مع قصده إلى الفعل، فلو لم يقصد كان خطأ محضا كما تقرر.( آت)ص 350
