عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ حَمَّادِ بْنِ عِيسَى عَنْ حَرِيزٍ عَنْ زُرَارَةَ وَ مُحَمَّدِ بْنِ مُسْلِمٍ وَ أَبِي بَصِيرٍ قَالُوا قُلْنَا لَهُ بِئْرٌ يُتَوَضَّأُ مِنْهَا يَجْرِي الْبَوْلُ قَرِيباً مِنْهَا أَ يُنَجِّسُهَا قَالَ

فَقَالَ إِنْ كَانَتِ الْبِئْرُ فِي أَعْلَى الْوَادِي وَ الْوَادِي يَجْرِي فِيهِ الْبَوْلُ مِنْ تَحْتِهَا وَ كَانَ بَيْنَهُمَا قَدْرُ ثَلَاثَةِ أَذْرُعٍ أَوْ أَرْبَعَةِ أَذْرُعٍ لَمْ يُنَجِّسْ ذَلِكَ شَيْءٌ وَ إِنْ كَانَ أَقَلَّ مِنْ ذَلِكَ يُنَجِّسُهَا وَ إِنْ كَانَتِ الْبِئْرُ فِي أَسْفَلِ الْوَادِي وَ يَمُرُّ الْمَاءُ عَلَيْهَا وَ كَانَ بَيْنَ الْبِئْرِ وَ بَيْنَهُ تِسْعَةُ أَذْرُعٍ لَمْ يُنَجِّسْهَا وَ مَا كَانَ أَقَلَّ مِنْ ذَلِكَ فَلَا يُتَوَضَّأُ مِنْهُ قَالَ زُرَارَةُ فَقُلْتُ لَهُ فَإِنْ كَانَ مَجْرَى الْبَوْلِ بِلِزْقِهَا وَ كَانَ لَا يَثْبُتُ عَلَى الْأَرْضِ فَقَالَ مَا لَمْ يَكُنْ لَهُ قَرَارٌ فَلَيْسَ بِهِ بَأْسٌ وَ إِنِ اسْتَقَرَّ مِنْهُ قَلِيلٌ فَإِنَّهُ لَا يَثْقُبُ الْأَرْضَ وَ لَا قَعْرَ لَهُ حَتَّى يَبْلُغَ الْبِئْرَ وَ لَيْسَ عَلَى الْبِئْرِ مِنْهُ بَأْسٌ فَيُتَوَضَّأُ مِنْهُ إِنَّمَا ذَلِكَ إِذَا اسْتَنْقَعَ كُلُّهُ.

2. Ali ibn Ibrahim has narrated from his father from Hammad ibn ‘Isa from Hariz from Zurarah, Muhammad ibn Muslim and abu Basir who have said the following: “We once asked him (abu ‘Abd Allah (a.s.) ,) about a well which is used for Wudu’ and nearby urine flows. ‘Is such a well Najis (unclean)? He (the Imam) replied, ‘If the well is above the place where urine flows below the well and there is a distance of three or four yards in between, it does not make anything of the well Najis (unclean) but if the distance is less than this, the well becomes Najis (unclean). If the well is below the place where water (urine) flows and there is a distance of nine yards between them it does not make the well Najis (unclean). If the distance is less than this then it cannot be used for Wudu’ Zurarah then asked, ‘What happens if the place is steep and urine flows fast and is not stationary on the ground?’ He (the Imam) said, ‘If it is not stationary it is not harmful, and even if a little of it is stationary, it does not make a deep hole in the ground to reach the well and it is not harmful to the well, thus it can be used for Wudu’. It is harmful to the well only when all of it (urine) is absorbed in the ground.’”

[1]ظاهره الفوقية بحسب القرار و يحتمل الجهة أيضا و المراد أن البئر أعلى من الوادى التي تجرى فيها البول.( آت)ص 8
[2]أي أسفل من الوادى. و« يسر الماء» أي البول عليها بعكس السابق و التعبير عن وادى البول بالماء يدلّ على أنّه قد وصل الوادى الى الماء.( آت)ص 8
[3]في التهذيب ج 1 ص 116:« قال زرارة: فقلت له: فان كان يجرى بلزقها و كان لا ينبت على الأرض» و هكذا في الاستبصار ج 1 ص 46 و في بعض نسخ التهذيب« و لا يثبت على الأرض».ص 8
