سُئِلَ أَبُو عَبْدِ اللَّهِ ع عَنْ رَجُلٍ أَعْطَى رَجُلًا مَالًا يَحُجُّ عَنْهُ فَحَجَّ عَنْ نَفْسِهِ فَقَالَ هِيَ عَنْ صَاحِبِ الْمَالِ.

2. Muhammad ibn Yahya in a marfu‘ manner has narrated the following: “Abu ‘Abd Allah (a.s.), was once asked about a man who receives a certain amount to perform al-Hajj for another person, but he performs al-Hajj for himself. He (the Imam) said, ‘It is for the owner of the asset.’”

[2]اعلم ان المقطوع به في كلام الاصحاب انه لا يجوز للنائب عدول النية إلى نفسه و اختلفوا فيما إذا عدل النية فذهب أكثر المتأخرين إلى أنّه لا يجزئ عن واحد منهما فيقع باطلا و قال الشيخ بوقوعه عن المستأجر و اختاره المحقق في المعتبر و هذا الخبر يدلّ على مختارهما و طعن فيه بضعف السند و مخالفة الأصول و يمكن حمله على الحجّ المندوب و يكون المراد أن الثواب لصاحب المال.( آت)ص 311
