وَ فِي رِوَايَةِ غِيَاثِ بْنِ إِبْرَاهِيمَ عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ عَنْ أَبِيهِ ع أَنَّ عَلِيّاً ع ضَمَّنَ صَاحِبَ الدَّابَّةِ مَا وَطِئَتْ بِيَدَيْهَا وَ مَا نَفَحَتْ بِرِجْلَيْهَا فَلَا ضَمَانَ عَلَيْهِ إِلَّا أَنْ يَضْرِبَهَا إِنْسَانٌ.

Hadith.5353 - In the narration of Ghiyath ibn Ibrahim from Imam Jafar ibn Muhammad Al-Sadiq (as) from his father, Imam Muhammad ibn Ali Al-Baqir (as): "Indeed, Imam Ali ibn Abi Talib (as) held the owner of the animal liable for what it trampled with its front legs and what it struck with its hind legs. However, there is no liability upon him unless a person strikes the animal."

[3]روى نحوه في الكافي عن أبي مريم عن أبي جعفر عليه السلام، و يدلّ على تفصيل آخر غير المشهور، و يمكن حمله على المشهور بأن يكون المراد ما يطأ عليه باليدين و الرجلين و يكون الضمان باعتبار اليدين، و قوله:« الا أن يضربها إنسان» الاستثناء منقطع أي يضمن الضارب حينئذ.( المرآة).ص 156
