وَ رَوَى صَفْوَانُ بْنُ يَحْيَى عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْحَجَّاجِ قَالَ سَأَلْتُ

أَبَا عَبْدِ اللَّهِ ع عَنِ الْحَمِيلِ فَقَالَ وَ أَيُّ شَيْءٍ الْحَمِيلُ فَقُلْتُ الْمَرْأَةُ تُسْبَى مِنْ أَرْضِهَا مَعَهَا الْوَلَدُ الصَّغِيرُ فَتَقُولُ هُوَ ابْنِي وَ الرَّجُلُ يُسْبَى فَيَلْقَى أَخَاهُ فَيَقُولُ هُوَ أَخِي لَيْسَ لَهُمَا بَيِّنَةٌ إِلَّا قَوْلُهُمَا قَالَ فَمَا يَقُولُ فِيهِ النَّاسُ عِنْدَكُمْ قُلْتُ لَا يُوَرِّثُونَهُ إِذَا لَمْ يَكُنْ لَهُمَا عَلَى وِلَادَتِهِ بَيِّنَةٌ إِنَّمَا كَانَ وِلَادَتُهُ فِي الشِّرْكِ قَالَ سُبْحَانَ اللَّهِ إِذَا جَاءَتْ بِابْنِهَا لَمْ تَزَلْ مُقِرَّةً بِهِ وَ إِذَا عَرَفَ أَخَاهُ وَ كَانَ ذَلِكَ فِي صِحَّةٍ مِنْهُمَا لَمْ يَزَالا مُقِرَّيْنِ بِذَلِكَ وَرِثَ بَعْضُهُمْ بَعْضاً.

Hadith.5676 - Safwan ibn Yahya narrated from Abdur Rahman ibn Al-Hajjaj, who said: I asked Abu Abdullah (as) about the hamil (the child in the womb). Imam (as) asked: "And what is the hamil?" I said: "A woman is captured from her land along with her young child, and she claims, 'This is my son.' Similarly, a man is captured and meets his brother, claiming, 'This is my brother,' but they have no evidence except their word." Imam (as) then asked: "And what do the people among you say about this?" I replied: "They do not allow inheritance unless they have proof of the child's birth, especially if the birth occurred during the period of disbelief (before Islam)." Imam (as) said: "Glory be to Allah (swt)! If she continuously acknowledges the child as hers, and if he recognizes his brother, and both of them were sound in mind and body when making such claims, they will both remain firm in their acknowledgment, and they will inherit from one another."

[3]أي كان ذلك النسب الذي أقربه أو كان ذلك الإقرار صحيحا بحسب السن و غيره، و ليس بين هذا الخبر و الذي تقدم منافاة لان الحميل في الأول بمعنى أنّها جاءت به و هو في بطنها و ما رآه الذي يدعى بنوته أو أخوته، و في الثاني بمعنى أنّه تولد في دار الشرك و هم رأوه فيها و هو رآهم( مراد) أقول: حمل الشيخ في التهذيبين الخبر الأوّل على ضرب من التقية لموافقته لمذهب بعض العامّة.ص 314
