Chapter on the Inheritance of the Captive

قَالَ أَبُو عَبْدِ اللَّهِ ع‌ لَا يُوَرَّثُ الْحَمِيلُ إِلَّا بِبَيِّنَةٍ قَالَ وَ الْحَمِيلُ هُوَ الَّذِي تَأْتِي‌ بِهِ الْمَرْأَةُ حُبْلَى قَدْ سُبِيَتْ وَ هِيَ حُبْلَى فَيَعْرِفُهُ بِذَلِكَ بَعْدُ أَبُوهُ أَوْ أَخُوهُ‌[1].

Hadith.5675 - Al-Hasan ibn Mahbub narrated from Ibn Mihzam, from Talhah ibn Zayd, who said that Abu Abdullah (as) said: "Child in the womb (hamil) will not inherit except with clear evidence." أَبَا عَبْدِ اللَّهِ ع عَنِ الْحَمِيلِ فَقَالَ وَ أَيُّ شَيْ‌ءٍ الْحَمِيلُ فَقُلْتُ الْمَرْأَةُ تُسْبَى مِنْ أَرْضِهَا مَعَهَا الْوَلَدُ الصَّغِيرُ فَتَقُولُ هُوَ ابْنِي وَ الرَّجُلُ يُسْبَى فَيَلْقَى أَخَاهُ فَيَقُولُ هُوَ أَخِي لَيْسَ لَهُمَا بَيِّنَةٌ إِلَّا قَوْلُهُمَا قَالَ فَمَا يَقُولُ فِيهِ النَّاسُ عِنْدَكُمْ قُلْتُ لَا يُوَرِّثُونَهُ‌[2] إِذَا لَمْ يَكُنْ لَهُمَا عَلَى وِلَادَتِهِ بَيِّنَةٌ إِنَّمَا كَانَ و
