[٢]الظاهر أنّه نوى لنفسه ما يصلون و يمكن حمله على أنّه نوى الأولى و سؤال الراوي لظنه لزوم التوافق بين الصلاتين بل قيل هذا هو الأظهر. و نقل في المنتهى الإجماع على جواز اقتداء المفترض مع اختلاف الفرضين.( آت)
[٣]يدل على عدم جواز ائتمام الظهر بالعصر و لم يقل به أحد و كان ارساله مع وجود المعارض و عدم القائل يمنع العمل به.( آت)
[٤]قوله:« يرفع رأسه قبل الامام» أي عامدا. و قال صاحب المدارك: الحكم بوجوب الاستمرار مع تعمد رفع المأموم رأسه قبل الامام مذهب الاصحاب.

سَأَلْتُهُ عَنِ الرَّجُلِ صَلَّى مَعَ قَوْمٍ وَ هُوَ يَرَى أَنَّهَا الْأُولَى وَ كَانَتِ الْعَصْرَ قَالَ فَلْيَجْعَلْهَا الْأُولَى وَ لْيُصَلِّ الْعَصْرَ. - وَ فِي حَدِيثٍ آخَرَ فَإِنْ عَلِمَ أَنَّهُمْ فِي صَلَاةِ الْعَصْرِ وَ لَمْ يَكُنْ صَلَّى الْأُولَى فَلَا يَدْخُلْ مَعَهُمْ
12. A group of our people has narrated from Ahmad ibn Muhammad from al-Husayn ibn Sa‘id from Fadalah ibn Ayyub from al-Husayn ibn ‘Uthman from Sama‘ah from abu Basir from who has said the following: “I once asked him (the Imam) (a.s.), about a man who performs Salah (prayer) with a people and he thinks it is the first (al-Dhuhr) but it is al-‘Asr. He (the Imam) said, ‘He considers it the first and perform al-‘Asr.’” In another Hadith it is said, ‘If he knows that it is al-‘Asr and has not performed the one before, he is not to join them.”’

سَأَلْتُ أَحَدَهُمَا ص عَنْ إِمَامٍ أَمَّ قَوْماً فَذَكَرَ أَنَّهُ لَمْ يَكُنْ عَلَى وُضُوءٍ فَانْصَرَفَ وَ أَخَذَ بِيَدِ رَجُلٍ وَ أَدْخَلَهُ فَقَدَّمَهُ وَ لَمْ يَعْلَمِ الَّذِي قُدِّمَ مَا صَلَّى الْقَوْمُ قَالَ يُصَلِّي بِهِمْ فَإِنْ أَخْطَأَ سَبَّحَ الْقَوْمُ بِهِ وَ بَنَى عَلَى صَلَاةِ الَّذِي كَانَ قَبْلَهُ.
13. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn Hadid from Jamil from who has said the following: “I once asked one of the two Imam, ‘Alayhim al-Salam, about the case of an Imam who leads a people and remembers that his Wudu’ is not valid. He moves away and holds the hand of another man to make him lead and he does not know how much is performed. He (the Imam) said, ‘He performs Salah (prayer) with them and if he makes a mistake, the people remind him by saying Tasbih (Allah is free of all defects) to complete Salah (prayer) as it was before him.’”

سُئِلَ أَبُو عَبْدِ اللَّهِ ع عَنِ الَّذِي يَرْفَعُ رَأْسَهُ قَبْلَ الْإِمَامِ أَ يَعُودُ فَيَرْكَعُ إِذَا أَبْطَأَ الْإِمَامُ أَنْ يَرْفَعَ رَأْسَهُ قَالَ لَا.
14. Ali ibn Ibrahim has narrated from his father from ’Abd Allah ibn al-Mughirah from Ghiyath ibn Ibrahim who has said the following: “Abu ‘Abd Allah (a.s.), was asked about one who raises his head before the Imam. Is he to return to Ruku‘ (bowing down on one’s knees) if the Imam delays, or raise his head?’ He (the Imam) said, ‘No, he must not raise his head.’”

رَأَيْتُ أَبَا عَبْدِ اللَّهِ ع وَ دَخَلَ الْمَسْجِدَ الْحَرَامَ فِي صَلَاةِ الْعَصْرِ فَلَمَّا كَانَ دُونَ الصُّفُوفِ رَكَعُوا فَرَكَعَ وَحْدَهُ وَ سَجَدَ سَجْدَتَيْنِ ثُمَّ قَامَ فَمَضَى حَتَّى لَحِقَ الصُّفُوفَ.
1. A group has narrated from Ahmad ibn Muhammad from al-Husayn ibn Sa‘id from Hammad ibn ‘Isa from Mu‘awiyah ibn Wahab who has said the following: “I once saw abu ’Abd Allah (a.s.), entering Masjid al-Haram during al-‘Asr Salah (prayer), when he was near the rows, they performed Ruku‘ (bowing down on one’s knees). He (the Imam) performed Ruku‘ (bowing down on one’s knees) alone and two Sajdah (prostration). He (the Imam) then stood up and walked until he joined the rows.’”
