قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع إِنَّا نَشْتَرِي الْمَتَاعَ بِنَظِرَةٍ فَيَجِيءُ الرَّجُلُ فَيَقُولُ بِكَمْ تَقَوَّمَ عَلَيْكَ فَأَقُولُ بِكَذَا وَ كَذَا فَأَبِيعُهُ بِرِبْحٍ فَقَالَ إِذَا بِعْتَهُ مُرَابَحَةً كَانَ لَهُ مِنَ النَّظِرَةِ مِثْلُ مَا لَكَ قَالَ فَاسْتَرْجَعْتُ وَ قُلْتُ هَلَكْنَا فَقَالَ مِمَّ فَقُلْتُ لِأَنَّ مَا فِي الْأَرْضِ ثَوْبٌ إِلَّا أَبِيعُهُ مُرَابَحَةً يُشْتَرَى مِنِّي وَ لَوْ وُضِعْتُ مِنْ رَأْسِ الْمَالِ حَتَّى أَقُولَ بِكَذَا وَ كَذَا قَالَ فَلَمَّا رَأَى مَا شَقَّ عَلَيَّ قَالَ أَ فَلَا أَفْتَحُ لَكَ بَاباً يَكُونُ لَكَ فِيهِ فَرَجٌ قُلْ قَامَ عَلَيَّ بِكَذَا وَ كَذَا وَ أَبِيعُكَ بِزِيَادَةِ كَذَا وَ كَذَا وَ لَا تَقُلْ بِرِبْحٍ.
7. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Safwan from Ayyub ibn Rashid from Muyassir Bayya’ al- Zuttiy who has said the following: “I once said to abu ‘Abd Allah (a.s.), ‘I buy goods with deferred payment for a certain time. A man comes to me and says, ‘What is the price.’ I say, ‘It is so and so amount.’ I then sell it to him with a certain amount of profit. He (the Imam) said, ‘When you sell it in the form of Murabahah (capital plus profit) he has a share in the value of deferred payment also just as you have.’ I then said Istirja‘ (the expression, ‘To Allah we belong and to Him we all return’) and said, ‘We are destroyed.’ He (the Imam) said, ‘Because of what?’ I replied, ‘There is no cloth on earth that I buy without Murabahah (capital plus profit) and they are bought from me even if I reduce the capital to say it is for so and so amount. When he (the Imam) saw my difficulties he (the Imam) said, ‘Do you want that I open a door for you to make things easier for you? Say, “It has costed me so and so and I sell it for so and so price;” do not say I sell it in the form of Murabahah (capital plus profit).”’

[5]قوله:« الا أبيعه مرابحة» يحتمل أن يكون لفظ الا زائدة و أن يكون بمعنى الواو العاطفة فيكون المعنى ما في الأرض ثوب و أريد بيعه، و ليس في الفقيه كلمة« الا» و هو الأظهر و يمكن ان يكون اسم ان ضمير الشأن و« ما» نافية و« يشترى» استفهام انكارى. كما قاله المجلسيّ رحمه اللّه و قال أيضا: و لعلّ الوجه في الجواب أن لفظ الربح صريح في المرابحة شرعا بخلاف لفظ الزيادة و يمكن حمله على المساومة بأن يكون هذا القول قبل البيع لكنه بعيد و بالجملة لم أعثر على من عمل بظاهره من الاصحاب و يشكل العدول به مع جهالته عن فحاوى سائر الاخبار. و قيل في تصحيح العبارة: ان كلمة« الا» مركبة من أن المصدرية و لاء النافية و المصدر نائب مناب ظرف الزمان.ص 198
قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع إِنَّا نَشْتَرِي الْعِدْلَ فِيهِ مِائَةُ ثَوْبٍ خِيَارٍ وَ شِرَارٍ دَسْتْشُمَارَ فَيَجِيئُنَا الرَّجُلُ فَيَأْخُذُ مِنَ الْعِدْلِ تِسْعِينَ ثَوْباً بِرِبْحِ دِرْهَمٍ دِرْهَمٍ فَيَنْبَغِي لَنَا أَنْ نَبِيعَ الْبَاقِيَ عَلَى مِثْلِ مَا بِعْنَا فَقَالَ لَا إِلَّا أَنْ يَشْتَرِيَ الثَّوْبَ وَحْدَهُ.
8. A number of our people have narrated from Sahl ibn Ziyad from Ali ibn Asbat from Asbat ibn Salim who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case in which we buy a bundle of a hundred or so cloths in which there are good and bad ones ‘dast shumar ’ (farsi word for mixed). A man comes and takes ninety for the bundle with profit of one dirham for each. Is it proper for us to sell the rest as just we sold? He (the Imam) said, ‘No, unless he alone buys the cloth.’”

لَا بَأْسَ بِالسَّلَمِ فِي الْمَتَاعِ إِذَا وَصَفْتَ الطُّولَ وَ الْعَرْضَ.
1. Ali ibn Ibrahim has narrated from his father from ibn abu ‘ Umayr from Jamil ibn Darraj who has said the following: “Abu ‘ Abd Allah (a.s.), has said, ‘Advance payment to receive goods at an appointed time in the future is lawful if the length and width are fully described.”’

سَأَلْتُهُ عَنِ السَّلَمَ وَ هُوَ السَّلَفُ فِي الْحَرِيرِ وَ الْمَتَاعِ الَّذِي يُصْنَعُ فِي الْبَلَدِ الَّذِي أَنْتَ فِيهِ قَالَ نَعَمْ إِذَا كَانَ إِلَى أَجَلٍ مَعْلُومٍ.
2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ‘Uthman ibn ‘Isa from Sama‘ah who has said the following: “I once asked him (the Imam) (a.s.), about advance payment to receive goods on a date in future which is payment in advance for silk or goods made in the location where you live. He (the Imam) said, ‘Yes, it is lawful if the time is known.’”

3. Ali ibn Ibrahim has narrated from his father from ‘Isma’il ibn Marrar from Yunus from Mu‘awiyah ibn ‘Ammar who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘Advance payment to receive goods in future is lawful if the length and width is made known.’”

قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع يَجِيئُنِي الرَّجُلُ يَطْلُبُ مِنِّي الْمَتَاعَ بِعَشَرَةِ آلَافِ دِرْهَمٍ أَوْ أَقَلَّ أَوْ أَكْثَرَ وَ لَيْسَ عِنْدِي إِلَّا بِأَلْفِ دِرْهَمٍ فَأَسْتَعِيرُ مِنْ جَارِي وَ آخُذُ مِنْ ذَا وَ ذَا فَأَبِيعُهُ مِنْهُ ثُمَّ أَشْتَرِيهِ مِنْهُ أَوْ آمُرُ مَنْ يَشْتَرِيهِ فَأَرُدُّهُ عَلَى أَصْحَابِهِ قَالَ لَا بَأْسَ بِهِ.
1. A number of our people have narrated from Ahmad ibn Muhammad from Safwan from Musa ibn Bakr from Hadid ibn Hakim al- Azdiy who has said the following: “This is concerning my question before abu ‘ Abd Allah (a.s.), about the case of a man who comes to me and asks me for certain goods at the price of ten thousand dirham or less or more but I have only what is worth one thousand dirham. I then borrow from my neighbor and take from this and that person to complete the amount and sell to him; then buy from him or ask someone else to buy from him so that I then can return to the people from whom I had borrowed. He (the Imam) said, It is lawful.’”
