[١]كانه عليه السلام علم كذبه في ذلك فأخير به كالخبر السابق فلا يكون الحكم مطردا و قطع الاصحاب بحرمة بنت العمة و الخالة بالزنا السابق بامها و جعلوها مستثنى من الحكم بعدم التحريم بالزنا السابق و الرواية انما تضمنت حكم الخالة فالحاق العمة بها يحتاج إلى دليل لكن الاخبار العامّة كاف في اثبات ذلك فيهما و في غيرهما كما مر.( آت)

إِنَّ رَجُلًا مِنْ أَصْحَابِنَا تَزَوَّجَ امْرَأَةً فَقَالَ لِي أُحِبُّ أَنْ تَسْأَلَ أَبَا عَبْدِ اللَّهِ ع وَ تَقُولَ لَهُ إِنَّ رَجُلًا مِنْ أَصْحَابِنَا تَزَوَّجَ امْرَأَةً قَدْ زَعَمَ أَنَّهُ كَانَ يُلَاعِبُ أُمَّهَا وَ يُقَبِّلُهَا مِنْ غَيْرِ أَنْ يَكُونَ أَفْضَى إِلَيْهَا قَالَ فَسَأَلْتُ أَبَا عَبْدِ اللَّهِ ع فَقَالَ لِي كَذَبَ مُرْهُ فَلْيُفَارِقْهَا قَالَ فَرَجَعْتُ مِنْ سَفَرِي فَأَخْبَرْتُ الرَّجُلَ بِمَا قَالَ أَبُو عَبْدِ اللَّهِ ع فَوَ اللَّهِ مَا دَفَعَ ذَلِكَ عَنْ نَفْسِهِ وَ خَلَّى سَبِيلَهَا.
9. Ibn Mahbub has narrated from Hisham ibn Salim from Yazid al-Kunnasiy who has said the following: “A certain person of our people married a woman and said to me, ‘I like if you ask abu ‘Abd Allah (a.s.), about the case of a man from our people who has married a woman and thinks that he may have played with her mother like kissing without sexual intercourse.’ He (the narrator) has said, ‘I asked abu ‘Abd Allah (a.s.), about it and he said, ‘He has lied. Tell him to separate from her.’ I returned from my journey and informed the man of what abu ‘Abd Allah (a.s.), had said. By Allah, he did not defend himself and sent her to go away.’”

سَأَلَ رَجُلٌ أَبَا عَبْدِ اللَّهِ ع وَ أَنَا جَالِسٌ عَنْ رَجُلٍ نَالَ مِنْ خَالَتِهِ فِي شَبَابِهِ ثُمَّ ارْتَدَعَ أَ يَتَزَوَّجُ ابْنَتَهَا فَقَالَ لَا قُلْتُ إِنَّهُ لَمْ يَكُنْ أَفْضَى إِلَيْهَا إِنَّمَا كَانَ شَيْءٌ دُونَ شَيْءٍ فَقَالَ لَا يُصَدَّقُ وَ لَا كَرَامَةَ.
10. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from abu Ayyub al-Khazzaz from Muhammad ibn Muslim who has said the following: “Once, a man asked abu ‘Abd Allah (a.s.), when I was sitting, about the case of a man who when young was involved with his maternal aunt then refrained, if he could marry her daughter. He (the Imam) said, ‘No, he cannot do so.’ He then asked, ‘What happens if there was no sexual intercourse, but it was something near the thing?’ He (the Imam) said, ‘No, his words are not accepted, and it is not honorable.’”

قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع رَجُلٌ أَتَى غُلَاماً أَ تَحِلُّ لَهُ أُخْتُهُ قَالَ فَقَالَ إِنْ كَانَ ثَقَبَ فَلَا.
1. Al-Husayn b. Muhammad has narrated from Mu’allah b. Muhammad from al-Hasan b. Ali from Hammad b. Uthman who said: I asked Abi Abdillah (as): "A man who commits a sinful act with a boy, is his sister lawful for him (to marry)?' He (the Imam) said, 'If he made a hole, then no."

إِذَا أَوْقَبَ حَرُمَتْ عَلَيْهِ ابْنَتُهُ وَ أُخْتُهُ.
2. Ali b. Ibrahim has narrated from his father from Ibn Abi Umayr from some of our people from Abu Abdullah (as) about the case of a man who plays with a boy, he said: 'If he makes a hole in him, his daughter and sister become unlawful for him.’

كُنْتُ عِنْدَ أَبِي عَبْدِ اللَّهِ ع فَأَتَاهُ رَجُلٌ فَقَالَ لَهُ جُعِلْتُ فِدَاكَ مَا تَرَى فِي شَابَّيْنِ كَانَا مُضْطَجِعَيْنِ فَوُلِدَ لِهَذَا غُلَامٌ وَ لِلْآخَرِ جَارِيَةٌ أَ يَتَزَوَّجُ ابْنُ هَذَا ابْنَةَ هَذَا قَالَ فَقَالَ نَعَمْ سُبْحَانَ اللَّهِ لِمَ لَا يَحِلُّ فَقَالَ إِنَّهُ كَانَ صَدِيقاً لَهُ قَالَ فَقَالَ وَ إِنْ كَانَ فَلَا بَأْسَ قَالَ فَقَالَ فَإِنَّهُ كَانَ يَفْعَلُ بِهِ قَالَ فَأَعْرَضَ بِوَجْهِهِ [عَنْهُ] ثُمَّ أَجَابَهُ وَ هُوَ مُسْتَتِرٌ بِذِرَاعَيْهِ فَقَالَ إِنْ كَانَ الَّذِي كَانَ مِنْهُ دُونَ الْإِيقَابِ فَلَا بَأْسَ أَنْ يَتَزَوَّجَ وَ إِنْ كَانَ قَدْ أَوْقَبَ فَلَا يَحِلُّ لَهُ أَنْ يَتَزَوَّجَ.
3. Ali ibn Ibrahim has narrated from his father or from Muhammad ibn Ali from Musa ibn Sa‘dan from certain persons of his people who have said the following: “Once I was with abu ‘Abd Allah (a.s.), when a man came and said, ‘I pray to Allah to keep my soul in service for your cause, if two young men slept together and one has a son and the other has a daughter; if his son could marry the other man’s daughter.’ He (the narrator) has said that he (the Imam) said, ‘Yes, Allah is free of all defects, why can it be unlawful?’ The man said they were friends. He (the Imam) said, ‘Even if such is the case it is not unlawful.’ The man said, ‘He was doing to him.’ He (the Imam) turned away his face then, while covering his face with his arms, said, ‘Even if it was what it was without doing the hole it is not unlawful to marry but if awqaba (made a hole in him) then marriage is not lawful.’”
