الذِّمِّيُّ تَكُونُ لَهُ الْمَرْأَةُ الذِّمِّيَّةُ فَتُسْلِمُ امْرَأَتُهُ قَالَ هِيَ امْرَأَتُهُ يَكُونُ عِنْدَهَا بِالنَّهَارِ وَ لَا يَكُونُ عِنْدَهَا بِاللَّيْلِ قَالَ فَإِنْ أَسْلَمَ الرَّجُلُ وَ لَمْ تُسْلِمِ الْمَرْأَةُ يَكُونُ الرَّجُلُ عِنْدَهَا بِاللَّيْلِ وَ النَّهَارِ.
8. A number of our people have narrated from Sahl ibn Ziyad from Muhammad ibn ‘Isa from Yunus who has said the following: “I once asked him (the Imam) (a.s.), about the case of a taxpayer man who had a taxpayer wife and she became a Muslim, he (the Imam) said, ‘She is his wife who stays with him during the day but not during the night.’ He (the Imam) said, ‘If the man becomes a Muslim he stays with her during the night as well as the day.’”

قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع النَّصْرَانِيُّ يَتَزَوَّجُ النَّصْرَانِيَّةَ عَلَى ثَلَاثِينَ دَنّاً مِنْ خَمْرٍ وَ ثَلَاثِينَ خِنْزِيراً ثُمَّ أَسْلَمَا بَعْدَ ذَلِكَ وَ لَمْ يَكُنْ دَخَلَ بِهَا قَالَ يَنْظُرُ كَمْ قِيمَةُ الْخَمْرِ وَ كَمْ قِيمَةُ الْخَنَازِيرِ فَيُرْسِلُ بِهَا إِلَيْهَا ثُمَّ يَدْخُلُ عَلَيْهَا وَ هُمَا عَلَى نِكَاحِهِمَا الْأَوَّلِ.
9. A number of our people have narrated from Ahmad ibn Muhammad ibn Khalid from his father from al-Qasim ibn Muhammad al- Jawhariy from Rumiy ibn Zurarah who has said the following: ‘This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man who is a Christian and marries a Christian woman for thirty sacks of wine and thirty pigs; then they become Muslims and he has not yet gone to bed with her. He (the Imam) said, ‘He must find out how much the value of wine and pigs is. He must send them to her, then he can go to bed with her and they remain with their first marriage.’”

سَمِعْتُهُ يَقُولُ يَحْرُمُ مِنَ الرَّضَاعِ مَا يَحْرُمُ مِنَ الْقَرَابَةِ.
1. Ali ibn Ibrahim has narrated from his father from ibn abu Najran from ‘ Abd Allah ibn Sinan who has said the following: “I once heard abu ‘Abd Allah (a.s.), saying, ‘Whoever is unlawful for marriage due to blood relationship becomes unlawful for marriage because of breastfeeding also.”’

يَحْرُمُ مِنَ الرَّضَاعِ مَا يَحْرُمُ مِنَ النَّسَبِ.
2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn ‘Isma’il from Muhammad ibn al-Fudayl from abu al-Sabbah al-Kinaniy who has said the following: “Once abu ‘Abd Allah (a.s.), was asked about breastfeeding. He (the Imam) said, ‘Because of breastfeeding, whoever is unlawful for marriage because of being a relative (blood relationship), becomes unlawful for marriage.’”

3. قَالَ أَمِيرُ الْمُؤْمِنِينَ ع عَرَضْتُ عَلَى رَسُولِ اللَّهِ ص ابْنَةَ حَمْزَةَ فَقَالَ أَ مَا عَلِمْتَ أَنَّهَا ابْنَةُ أَخِي مِنَ الرَّضَاعِ.
4. Al-Husayn from Muhammad has narrated from Mu’alla’ ibn Muhammad from al-Hassan ibn Ali from Aban ibn ‘Uthman from those who narrated to him who has said the following: “Abu ‘Abd Allah (a.s.), has said that ’Amir al-Mu’minin (a.s.), has said, ‘The daughter of Hamzah was proposed to the Messenger of Allah (saww) for marriage and he (the Messenger of Allah) said, “Did you not know that she is a daughter of my brother because of breastfeeding?'"

قَالَ أَمِيرُ الْمُؤْمِنِينَ ع فِي ابْنَةِ الْأَخِ مِنَ الرَّضَاعِ لَا آمُرُ بِهِ أَحَداً وَ لَا أَنْهَى عَنْهُ وَ إِنَّمَا أَنْهَى عَنْهُ نَفْسِي وَ وُلْدِي وَ قَالَ عُرِضَ عَلَى رَسُولِ اللَّهِ ص أَنْ يَتَزَوَّجَ ابْنَةَ حَمْزَةَ فَأَبَى رَسُولُ اللَّهِ ص وَ قَالَ هِيَ ابْنَةُ أَخِي مِنَ الرَّضَاعِ.
5. Ali ibn Ibrahim has narrated from his father from ibn abu ‘ Umayr from Hammad from al-Halabiy who has said the following: “Abu ‘Abd Allah (a.s.), has said that ’Amir al-Mu’minin (a.s.), has said, ‘In the case of a daughter of a brother because of breastfeeding I do not command anyone or prohibit. I only refrain myself and my sons.’ He (’Amir al-Mu’minin) said, ‘The daughter of Hamzah was proposed to the Messenger of Allah for marriage and he (the Messenger of Allah), (saww) refused and said, “She is a daughter of my brother because of breastfeeding.'"
