بَابُ مَا يُوجِبُ الْغُسْلَ عَلَى الرَّجُلِ وَ الْمَرْأَةِ

مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ الْحُسَيْنِ عَنْ صَفْوَانَ بْنِ يَحْيَى عَنِ الْعَلَاءِ بْنِ رَزِينٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَحَدِهِمَا ع قَالَ:

سَأَلْتُهُ مَتَى يَجِبُ الْغُسْلُ عَلَى الرَّجُلِ وَ الْمَرْأَةِ فَقَالَ إِذَا أَدْخَلَهُ فَقَدْ وَجَبَ الْغُسْلُ وَ الْمَهْرُ وَ الرَّجْمُ.

1. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn, from Safwan ibn Yahya, from al-‘Ala’ ibn Razin, from Muhammad ibn Muslim who has said the following: “I once asked one of the two Imam, ‘Alayhim al-Salam, ‘When does Ghusl (bath) become necessary for man and woman?’ He (the Imam) said, ‘After consummating sexual relation, Ghusl (bath), payment of al-Mahr (payment agreed upon during marriage) and stoning (if it is fornication) become necessary.’”

عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ عِيسَى عَنْ مُحَمَّدِ بْنِ إِسْمَاعِيلَ قَالَ:

سَأَلْتُ الرِّضَا ع عَنِ الرَّجُلِ يُجَامِعُ الْمَرْأَةَ قَرِيباً مِنَ الْفَرْجِ فَلَا يُنْزِلَانِ مَتَى يَجِبُ الْغُسْلُ فَقَالَ إِذَا الْتَقَى الْخِتَانَانِ فَقَدْ وَجَبَ الْغُسْلُ فَقُلْتُ الْتِقَاءُ الْخِتَانَيْنِ هُوَ غَيْبُوبَةُ الْحَشَفَةِ قَالَ نَعَمْ.

2. A number of our people have narrated from Ahmad ibn Muhammad ibn ‘Isa from Muhammad ibn ’Isma‘il who has said the following: “I once asked al-Rida (a.s.), about a man who performs sexual relation with woman near her vagina but does not discharge, if Ghusl (bath) becomes necessary. He (the Imam) said, ‘When private parts touch each other Ghusl (bath) becomes necessary.’ I (the narrator) then asked, ‘Is touching of private parts disappearance of glans penis?’ He (the Imam) replied, ‘Yes, it is such.’”

وَ بِهَذَا الْإِسْنَادِ عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ الْحَسَنِ بْنِ عَلِيِّ بْنِ يَقْطِينٍ عَنْ أَخِيهِ الْحُسَيْنِ عَنْ عَلِيِّ بْنِ يَقْطِينٍ قَالَ:

سَأَلْتُ أَبَا الْحَسَنِ ع عَنِ الرَّجُلِ يُصِيبُ الْجَارِيَةَ الْبِكْرَ لَا يُفْضِي إِلَيْهَا وَ لَا يُنْزِلُ‌ عَلَيْهَا أَ عَلَيْهَا غُسْلٌ وَ إِنْ كَانَتْ لَيْسَ بِبِكْرٍ ثُمَّ أَصَابَهَا وَ لَمْ يُفْضِ إِلَيْهَا أَ عَلَيْهَا غُسْلٌ قَالَ إِذَا وَقَعَ الْخِتَانُ عَلَى الْخِتَانِ فَقَدْ وَجَبَ الْغُسْلُ الْبِكْرُ وَ غَيْرُ الْبِكْرِ.

3. Through the same chain of narrators as that of the previous Hadith the narrator has narrated from Ahmad ibn Muhammad from al- Hassan ibn Ali ibn Yaqtin from his brother al-Husayn from Ali ibn Yaqtin who has said the following: “I once asked abu al-Hassan, Alayhi al-Salam, about a man who pollutes a virgin girl who does not lose her virginity and does not discharge semen on her. Is Ghusl (bath) necessary on her or if she is not a virgin and he is exposed to her but intercourse does not take place, if Ghusl (bath) is obligatory on her? He (the Imam) said, ‘When private part falls on private part, Ghusl (bath) becomes necessary - virgin or not virgin.’”

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادِ بْنِ عُثْمَانَ عَنْ عُبَيْدِ اللَّهِ‌ الْحَلَبِيِّ قَالَ:

4. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad ibn ‘Uthman from ‘Ubayd Allah al-Halabiy who has said the following: “I once asked abu ‘Abd Allah, Alayhi al-Salam, about one’s foreplay and Ghusl (bath). He (the Imam) said, ‘There is Ghusl (bath) obligatory if semen discharge takes place.’”

سَأَلْتُ الرِّضَا ع عَنِ الرَّجُلِ يَلْمِسُ فَرْجَ جَارِيَتِهِ حَتَّى تُنْزِلَ الْمَاءَ مِنْ غَيْرِ أَنْ يُبَاشِرَ يَعْبَثُ بِهَا بِيَدِهِ حَتَّى تُنْزِلَ قَالَ إِذَا أَنْزَلَتْ مِنْ شَهْوَةٍ فَعَلَيْهَا الْغُسْلُ.

5. A number of our people have narrated from Ahmad ibn Muhammad from Tsma‘il ibn Sa‘d al-Ash’ariy who has said the following: “I once asked al-Rida, Alayhi al-Salam, about a man who touches and plays by his hand with the private parts of his slave-girl without contact of his private part until she feels discharge, is Ghusl (bath) necessary on her? He (the Imam) said, ‘Ghusl (bath) is necessary if discharge is accompanied by orgasm.’”

6. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn Tsma‘il ibn Bazi‘ who has said the following: “I once asked al-Rida, Alayhi al-Salam, about a man who allows intercourse with a woman to take place but not in vagina, and she feels discharges, is Ghusl (bath) necessary on her? He (the Imam) said, ‘Yes, Ghusl (bath) is necessary for her.’”

الْحُسَيْنُ بْنُ مُحَمَّدٍ عَنْ عَبْدِ اللَّهِ بْنِ عَامِرٍ عَنْ عَلِيِّ بْنِ مَهْزِيَارَ عَنِ الْحُسَيْنِ بْنِ سَعِيدٍ عَنْ مُحَمَّدِ بْنِ الْفُضَيْلِ قَالَ:

سَأَلْتُ أَبَا الْحَسَنِ ع عَنِ الْمَرْأَةِ تُعَانِقُ زَوْجَهَا مِنْ خَلْفِهِ فَتَحَرَّكُ عَلَى ظَهْرِهِ فَتَأْتِيهَا الشَّهْوَةُ فَتُنْزِلُ الْمَاءَ عَلَيْهَا الْغُسْلُ أَوْ لَا يَجِبُ عَلَيْهَا الْغُسْلُ قَالَ إِذَا جَاءَتْهَا الشَّهْوَةُ فَأَنْزَلَتِ الْمَاءَ وَجَبَ عَلَيْهِ الْغُسْلُ.

7. Al-Husayn ibn Muhammad has narrated from ‘Abd Allah ibn ‘Amir from Ali ibn Mahziyar from al-Husayn ibn Sa‘id from Muhammad ibn al-Fudayl who has said the following: “I once asked abu al-Hassan (a.s.), about the case of a woman who hugs her husband from his backside. She moves and experiences orgasm and discharge, is Ghusl (bath) necessary on her? He (the Imam) said, ‘If she experiences orgasm and discharge, Ghusl (bath) becomes necessary.”’

مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ الْبَرْقِيِّ رَفَعَهُ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ:

إِذَا أَتَى الرَّجُلُ الْمَرْأَةَ فِي دُبُرِهَا فَلَمْ يُنْزِلْ فَلَا غُسْلَ عَلَيْهِمَا وَ إِنْ أَنْزَلَ فَعَلَيْهِ الْغُسْلُ وَ لَا غُسْلَ عَلَيْهَا.

8. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from al-Barqiy in a marfu‘ manner who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘If a man allows intercourse to take place in a woman’s anus without discharge of semen, Ghusl (bath) is not necessary on neither one of them, but if he discharges, Ghusl (bath) is necessary on him but it is not necessary on the woman.’”

[2]اختلف الاصحاب في وجوب الغسل بوطى دبر المرأة فالاكثرون و منهم السيّد و ابن الجنيد و ابن حمزة و ابن إدريس و المحقق و العلامة في جملة من كتبه على الوجوب و الشيخ في الاستبصار و النهاية و كذا الصدوق و سلار الى عدم الوجوب و اما دبر الرجل ففيه أيضا خلاف و السيّد قائل هنا أيضا بالوجوب و تردد الشيخ في المبسوط و ذهب المحقق هنا إلى عدم الوجوب و كذا في وطى البهيمة ذهب السيّد- رحمه اللّه- الى وجوب الغسل بل ادعى السيّد على الجميع اجماع الاصحاب و استدلّ على الجميع بخبر محمّد بن مسلم و بكثير من الاخبار و لا يخفى ما في الجميع من المناقشة اذ يمكن حمل الادخال في خبر ابن مسلم على المتعارف و أيضا على تقدير عمومه مخصص باخبار التقاء الختانين و لم يفرقوا في جميع المراتب بين الفاعل و المفعول.( آت)ص 47
