أَحْمَدُ بْنُ إِدْرِيسَ عَنِ الْحَسَنِ بْنِ عَلِيٍّ الْكُوفِيِّ عَنْ عُبَيْسِ بْنِ هِشَامٍ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي عَبْدِ اللَّهِ ع قَالَ:

قُلْتُ لَهُ رَجُلٌ أَسَرَتْهُ الرُّومُ وَ لَمْ يَصُمْ شَهْرَ رَمَضَانَ وَ لَمْ يَدْرِ أَيُّ شَهْرٍ هُوَ قَالَ يَصُومُ شَهْراً وَ يَتَوَخَّاهُ وَ يَحْسُبُ فَإِنْ كَانَ الشَّهْرُ الَّذِي صَامَهُ قَبْلَ شَهْرِ رَمَضَانَ لَمْ يُجْزِهِ وَ إِنْ كَانَ بَعْدَ رَمَضَانَ أَجْزَأَهُ.

Ahmad ibn Idris has narrated from al-Hassan ibn Ali al-Kufiy from ‘Ubays ibn Hisham from Aban ibn ‘Uthman from ‘Abd al- Rahman who has said the following: “I once asked abu ‘Abd Allah (a.s.), about a man who was captured by the Romans, and he did not fast in the month of Ramadan because he did not know which month was it. He (the Imam) said, ‘He is required to fast for one month. He then tries to calculate; if the month that he has fasted is before the month of Ramadan; it is not sufficient, and if it is after the month of Ramadan, it is then sufficient.’”

2. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Yahya ibn ‘Amr ibn Khalifah al-Zayyat from ‘Abd Allah ibn Bukayr from certain individuals of our people who has said the following: “One of the two Imam, ‘Alayhim al-Salam, has stated this Hadith. ‘The Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has said, “O young people, you may have carnal relations. If you are unable to do so, you should fast; it has a castrating effect (on carnal desires).””’

[3]قال الجزريّ: فى حديث النكاح« فمن لم يستطع فعليه بالصوم فانه وجاء» الوجاء أن ترض أنثيا الفحل رضا شديدا يذهب شهوة الجماع و يتنزل في قطعه منزلة الخصى و قد وجئ فهو موجوء. و قيل: هو أن توجأ العروق و الخصيتان بحالهما أراد أن الصوم يقطع النكاح كما يقطعه الوجاء.ص 180

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ الرَّجُلِ يَكُونُ لَهُ عَلَى الْآخَرِ مِائَةُ كُرِّ تَمْرٍ وَ لَهُ نَخْلٌ فَيَأْتِيهِ فَيَقُولُ أَعْطِنِي نَخْلَكَ هَذَا بِمَا عَلَيْكَ فَكَأَنَّهُ كَرِهَهُ قَالَ وَ سَأَلْتُهُ عَنِ الرَّجُلَيْنِ يَكُونُ بَيْنَهُمَا النَّخْلُ فَيَقُولُ أَحَدُهُمَا لِصَاحِبِهِ إِمَّا أَنْ تَأْخُذَ هَذَا النَّخْلَ بِكَذَا وَ كَذَا كَيْلًا مُسَمًّى أَوْ تُعْطِيَنِي نِصْفَ هَذَا الْكَيْلِ إِمَّا زَادَ أَوْ نَقَصَ وَ إِمَّا أَنْ آخُذَهُ أَنَا بِذَلِكَ قَالَ نَعَمْ لَا بَأْسَ بِهِ.

2. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Safwan from Ya’qub ibn Shu’ayb who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man to whom another man owes one hundred kur of dates and he has palm trees. He comes and says, ‘Give to me your palm trees for what you owe to me.’ It seemed as if he (the Imam) disliked it. I then asked about two men who have palm trees. One of them says to the other, ‘You can take the trees for such and such amount and give to me one-half more or less or I take the trees with the same condition. He (the Imam) said, ‘It is not harmful.’”

يُسْتَحَبُّ لِلرَّجُلِ أَنْ يَأْتِيَ أَهْلَهُ- أَوَّلَ لَيْلَةٍ مِنْ شَهْرِ رَمَضَانَ لِقَوْلِ اللَّهِ عَزَّ وَ جَلَّ- أُحِلَّ لَكُمْ لَيْلَةَ الصِّيامِ الرَّفَثُ إِلى‌ نِسائِكُمْ‌ وَ الرَّفَثُ الْمُجَامَعَةُ.

3. A number of our people have narrated from Ahmad ibn Muhammad from al-Qasim ibn Yahya from his grandfather, al-Hassan ibn Rashid from abu Basir who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘My father narrated to me from my grandfather from his ancestors, ‘Alayhim al-Salam, who have narrated this Hadith: “Imam Ali (a.s.), has said, ‘It is preferable for a man to go to bed with his wife during the first night of the month of Ramadan because of the words of Allah, most Majestic, most Glorious, “Al-Rafath (to go to bed with your wives)” is made lawful for you during the night of fasting.”””

3. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “Abu ‘Abd Allah (a.s.), was asked about walnuts that cannot be counted. The owner weighs a certain measurement, then counts the rest according to that measurement. He (the Imam) said, ‘It is not harmful.’”

4. Muhammad ibn Yahya has narrated from Ali ibn Ibrahim al-Ja’fariy from Muhammad ibn al-Fadl who has said the following: “Once al-Rida (a.s.), on the day of al-Fitr said to a certain individual of his servants, while praying for him. ‘O so and so, (I pray) may Allah accept from you and from us.’ Then it was the day of al-Adha’ and he (the Imam) said to him, ‘O so and so, may Allah accept from us and from you.’ I (the narrator) then asked, ‘O child of the Messenger of Allah, why is it that on the day of al-Fitr you said to him something different from what you said to him on the day of al-Adha?’ He (the Imam) replied, ‘What I said on the day of al-Fitr was because we both had done the same deed in equal form, but on the day of al-Adha’ we were able to offer a sacrifice, but he was unable to do so, thus we did something different from what he did.’”

Humayd ibn Ziyad has narrated from al-Hassan ibn Muhammad ibn Sama‘ah from those whom he has mentioned from Aban ibn ‘Uthman from ‘Abd al- Rahman ibn abu ‘Abd Allah who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man who buys something which is sold by measure or weight and takes it according to that standard. He (the Imam) said, ‘It is not harmful.’”

نَظَرَ إِلَى النَّاسِ فِي يَوْمِ فِطْرٍ يَلْعَبُونَ وَ يَضْحَكُونَ فَقَالَ لِأَصْحَابِهِ وَ الْتَفَتَ إِلَيْهِمْ إِنَّ اللَّهَ عَزَّ وَ جَلَّ خَلَقَ شَهْرَ رَمَضَانَ مِضْمَاراً لِخَلْقِهِ لِيَسْتَبِقُوا فِيهِ بِطَاعَتِهِ إِلَى رِضْوَانِهِ فَسَبَقَ فِيهِ قَوْمٌ فَفَازُوا وَ تَخَلَّفَ آخَرُونَ فَخَابُوا فَالْعَجَبُ كُلُّ الْعَجَبِ مِنَ الضَّاحِكِ اللَّاعِبِ فِي الْيَوْمِ الَّذِي يُثَابُ فِيهِ الْمُحْسِنُونَ وَ يَخِيبُ فِيهِ الْمُقَصِّرُونَ وَ ايْمُ اللَّهِ لَوْ كُشِفَ الْغِطَاءُ لَشُغِلَ مُحْسِنٌ بِإِحْسَانِهِ وَ مُسِي‌ءٌ بِإِسَاءَتِهِ.

5. A number of our people have narrated from Ahmad ibn abu ‘Abd Allah, from abu al-Sakhr, Ahmad ibn ‘Abd al-Rahim in a marfu‘ manner who has said the following: “Abu al-Hassan (a.s.), on the day of al-Fitr looking at the people who were playing and laughing, turned to his companions and said, ‘Allah, the Most Majestic, the Most Glorious, has created the month of Ramadan as an arena for His creature to compete in matters of obedience to Him to achieve His pleasure. Certain people have excelled, but others have remained behind and have failed. It is very strange that the laughing people play on the day when people of good deeds receive their reward and people with shortcomings fail. I swear by Allah, had the curtain been moved aside, people of good deeds and people of evil deeds each would have kept busy with their deeds.’”

5. Muhammad ibn ‘Isma’il has narrated from al-Fadl ibn Shadhan from Safwan ibn Yahya from ‘Is ibn al-Qasim who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man who has cattle; if he can sell their milk without measurement. He (the Imam) said, ‘Yes, he can do so until it stops (coming through the udder) or something similar.’”

6. Ali ibn Muhammad and Muhammad ibn abu ‘Abd Allah has narrated from Ishaq ibn Muhammad from Hamzah ibn Muhammad who has said the following: “I once wrote to abu Muhammad (a.s.), and asked, ‘Why has Allah made fasting obligatory?’ The answer was, ‘It is made obligatory so that affluent people can feel the taste of hunger and become compassionate to the poor.’”

سَأَلْتُهُ عَنِ اللَّبَنِ يُشْتَرَى وَ هُوَ فِي الضَّرْعِ قَالَ لَا إِلَّا أَنْ يَحْلُبَ لَكَ سُكُرُّجَةً فَيَقُولَ اشْتَرِ مِنِّي هَذَا اللَّبَنَ الَّذِي فِي السُّكُرُّجَةِ وَ مَا فِي ضُرُوعِهَا بِثَمَنٍ مُسَمًّى فَإِنْ لَمْ يَكُنْ فِي الضُّرُوعِ شَيْ‌ءٌ كَانَ مَا فِي السُّكُرُّجَةِ.

6. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from al-Husayn ibn Sa‘id from his brother al-Hassan from Zurarah from Sanaa ‘ah who has said the following: “I once asked him (the Imam) (a.s.), if milk which still is in the udder can be purchased. He (the Imam) said, ‘No, until it is milked in al-Sukurrujah (a bowl) and the seller can say, “Buy what is in al-Sukurruajah and that which is in the udder for the named price” and if there is nothing in the udder that which is in al-Sukurruajah is what is sold.’”

قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع مَا تَقُولُ فِي رَجُلٍ اشْتَرَى مِنْ رَجُلٍ أَصْوَافَ مِائَةِ نَعْجَةٍ وَ مَا فِي بُطُونِهَا مِنْ حَمْلٍ بِكَذَا وَ كَذَا دِرْهَماً قَالَ لَا بَأْسَ بِذَلِكَ إِنْ لَمْ يَكُنْ فِي بُطُونِهَا حَمْلٌ كَانَ رَأْسُ مَالِهِ فِي الصُّوفِ.

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub Ibrahim al-Karkhiy who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man who buys wool of a hundred sheep from another man and what is in their womb for so amount of dirham. He (the Imam) said, ‘It is not harmful; in case there is nothing in their womb he has his capital in the wool.’”

سَأَلْتُ أَبَا الْحَسَنِ مُوسَى ع قُلْتُ لَهُ أَ يَصْلُحُ لِي أَنْ أَشْتَرِيَ مِنَ الْقَوْمِ الْجَارِيَةَ الْآبِقَةَ وَ أُعْطِيَهُمُ الثَّمَنَ وَ أَطْلُبَهَا أَنَا قَالَ لَا يَصْلُحُ شِرَاؤُهَا إِلَّا أَنْ تَشْتَرِيَ مِنْهُمْ مَعَهَا شَيْئاً ثَوْباً أَوْ مَتَاعاً فَتَقُولَ لَهُمْ أَشْتَرِي مِنْكُمْ جَارِيَتَكُمْ فُلَانَةَ وَ هَذَا الْمَتَاعَ بِكَذَا وَ كَذَا دِرْهَماً فَإِنَّ ذَلِكَ جَائِزٌ.

9. Ahmad ibn Muhammad has narrated from ibn Mahbub from Rifa’ah al-Nakhkhas who has said the following: “I once asked abu al-Hassan, Musa (a.s.), if my buying a runaway slave-girl from a people and paying them the price but myself search to find her, is valid. He (the Imam) said, ‘It is not valid unless you buy from them a certain other item, like cloths or so and say to them, “I buy your so slave- girl and this item of goods for so and so amount of dirham.” This is permissible.’”

A number of our people have narrated from Sahl ibn Ziyad from Muhammad ibn al-Hassan ibn Shammun from al-Assam from Misma’ who has said the following: “Abu ‘Abd Allah (a.s.), has said that ’Amir al-Mu’minin (a.s.), prohibited buying the net of the fisherman by saying, ‘Spread your net and whatever comes in is mine for so and so amount.’”

Muhammad ibn Yahya has narrated from ‘Abd Allah ibn Muhammad from Ali ibn al-Hakam from and Humayd ibn Ziyad from al- Hassan ibn Muhammad ibn Sama‘ah from more than one person all from Aban ibn ‘Uthman from ‘Isma’il ibn al-Fadl al-Hashimiy who has said the following: “About the case of a man who accepts in a transaction, in exchange for what he pays, the taxes due on non-Muslim taxpayers, taxes on palm trees, on groves, on birds and does not know if any such items exist or not, abu ‘Abd Allah (a.s.), has said, ‘If he knows that at least one thing of it exists that he can have, he can buy and accept the deal with it.’”

Ali ibn Ibrahim has narrated from ibn Faddal from ibn Bukayr from a man from a certain persons of his people who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man who buys lime. He weighs a certain portion then accepts the rest without measurement. He (the Imam) said, ‘He can accept all of it with his certification or measure all of it.��”

Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Safwan from abu Sa‘id from ‘Abd al-Malik ibn ‘Amr who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about buying a hundred Rawiyah (a certain unit of measurement) of oil, then weigh one or two Rawiyah then accept the rest according to such weighing. He (the Imam) said, ‘It is not harmful.’”
