عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ عَنْ حَمَّادِ بْنِ عُثْمَانَ عَنْ مُحَمَّدِ بْنِ حَكِيمٍ قَالَ:

قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع الرَّجُلُ الْأَعْجَمِيُّ وَ الْمَرْأَةُ الضَّعِيفَةُ يَكُونَانِ مَعَ الْجَمَّالِ الْأَعْرَابِيِّ فَإِذَا أَفَاضَ بِهِمْ مِنْ عَرَفَاتٍ مَرَّ بِهِمْ كَمَا مَرَّ بِهِمْ إِلَى مِنًى وَ لَمْ يَنْزِلْ بِهِمْ جَمْعاً فَقَالَ أَ لَيْسَ قَدْ صَلَّوْا بِهَا فَقَدْ أَجْزَأَهُمْ قُلْتُ وَ إِنْ لَمْ يُصَلُّوا بِهَا قَالَ ذَكَرُوا اللَّهَ فِيهَا فَإِنْ كَانُوا ذَكَرُوا اللَّهَ فِيهَا فَقَدْ أَجْزَأَهُمْ.

1. A number of our people have narrated from Sahl ibn Ziyad Ahmad ibn Muhammad from ibn abu Nasr from Hammad ibn ‘Uthaman from Muhammad ibn al-Hakim who has said the following: “I once asked abu ‘ Abd Allah (a.s.), about a man who is a non- Arab with a weak woman and an Arab camel man who takes them to leave ’Arafat and pass along with them through al-Jam‘ (place of assembly al-Muzdalifah) to Mina’, without allowing them to disembark in al-Jam‘. He (the Imam) said, ’Had they been able to perform one Salat (prayer) in it (al-Jam‘) it would have been sufficient for them.’ I then asked, ‘What happens if they cannot perform one Salat (prayer) there ? 5 He (the Imam) said, ‘They can speak of Allah; if they say Dhikr of Allah (speak of Allah), it is sufficient for them. ‘“

لِيَسْتَأْذِنِ‌ الَّذِينَ مَلَكَتْ أَيْمانُكُمْ‌ وَ الَّذِينَ لَمْ يَبْلُغُوا الْحُلُمَ مِنْكُمْ‌ ثَلاثَ مَرَّاتٍ‌ كَمَا أَمَرَكُمُ اللَّهُ عَزَّ وَ جَلَ‌ وَ مَنْ بَلَغَ الْحُلُمَ فَلَا يَلِجُ عَلَى أُمِّهِ وَ لَا عَلَى أُخْتِهِ وَ لَا عَلَى خَالَتِهِ وَ لَا عَلَى سِوَى ذَلِكَ إِلَّا بِإِذْنٍ فَلَا تَأْذَنُوا حَتَّى يُسَلِّمَ وَ السَّلَامُ طَاعَةٌ لِلَّهِ عَزَّ وَ جَلَّ قَالَ وَ قَالَ أَبُو عَبْدِ اللَّهِ ع لِيَسْتَأْذِنْ عَلَيْكَ خَادِمُكَ إِذَا بَلَغَ الْحُلُمَ فِي ثَلَاثِ عَوْرَاتٍ إِذَا دَخَلَ فِي شَيْ‌ءٍ مِنْهُنَّ وَ لَوْ كَانَ بَيْتُهُ فِي بَيْتِكَ قَالَ وَ لْيَسْتَأْذِنْ عَلَيْكَ بَعْدَ الْعِشَاءِ- الَّتِي تُسَمَّى الْعَتَمَةَ وَ حِينَ تُصْبِحُ وَ حِينَ تَضَعُونَ ثِيَابَكُمْ مِنَ الظَّهِيرَةِ إِنَّمَا أَمَرَ اللَّهُ عَزَّ وَ جَلَّ بِذَلِكَ لِلْخَلْوَةِ فَإِنَّهَا سَاعَةُ غِرَّةٍ وَ خَلْوَةٍ.

1. A number of our people have narrated from Ahmad ibn abu ‘Abd Allah from his father and Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa from al-Husayn ibn Sa‘id all from al-Nadr ibn Suwayd from al-Qasim ibn Sulayman from Jarrah al- Mada’iniy who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘Your slaves and those of you who have not yet gained feeling of carnal desires must ask for your permission three times as Allah, most Majestic, most Glorious, has commanded. Those who have gained feeling of carnal desire must not enter the place of his mother, sister and maternal aunt or others without permission and you must not give permission unless he offers you Salam (the phrase of offering greeting of peace) in obedience to Allah, most Majestic, most Glorious.’ He (the narrator) has said that abu ‘Abd Allah (a.s.), then said, ‘Your servants who have gained feeling of carnal desires must ask you for permission during three times of privacy if they come to you in such times even if their home is the same as your home.’ He (the Imam) said, ‘They must ask you for permission after al-‘Isha’ called al-‘Atmah, in the morning and at noontime when you undress. Allah, most Majestic, most Glorious, has commanded as such because of privacy and at these times one is unaware and in retreat.’”

قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع جُعِلْتُ فِدَاكَ إِنَّ صَاحِبَيَّ هَذَيْنِ جَهِلَا أَنْ يَقِفَا بِالْمُزْدَلِفَةِ فَقَالَ يَرْجِعَانِ مَكَانَهُمَا فَيَقِفَانِ بِالْمَشْعَرِ سَاعَةً قُلْتُ فَإِنَّهُ لَمْ يُخْبِرْهُمَا أَحَدٌ حَتَّى كَانَ الْيَوْمُ وَ قَدْ نَفَرَ النَّاسُ قَالَ فَنَكَسَ رَأْسَهُ سَاعَةً ثُمَّ قَالَ أَ لَيْسَا قَدْ صَلَّيَا الْغَدَاةَ بِالْمُزْدَلِفَةِ قُلْتُ بَلَى فَقَالَ أَ لَيْسَا قَدْ قَنَتَا فِي صَلَاتِهِمَا قُلْتُ بَلَى فَقَالَ تَمَّ حَجُّهُمَا ثُمَّ قَالَ الْمَشْعَرُ مِنَ الْمُزْدَلِفَةِ وَ الْمُزْدَلِفَةُ مِنَ الْمَشْعَرِ وَ إِنَّمَا يَكْفِيهِمَا الْيَسِيرُ مِنَ الدُّعَاءِ.

2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn Sinan from ibn Muskan from abu Basir who has said the following: “I once said to abu ‘Abd Allah (a.s.), ‘I pray to Allah to keep my soul in service for your cause, these two of my friends due to ignorance have not stayed in al-Muzdalifah. He (the Imam) said, ‘They must go back to stay in al-Mash‘ar for an hour . 5 I then said that no one told them about it until today and people have already left. He (the Imam) then looked down for a while and said, ‘Did they perform the morning Salat (prayer) in al-Muzdalifah . 5 I said, ‘Yes, they did . 5 He (the Imam) asked, ‘Did they say Qunut (supplication after recitation in second Rak’at) in their Salat (prayer )? 5 I replied, ‘Yes, they did . 5 He (the Imam) said, ‘Their Hajj then is complete . 5 He (the Imam) then said, ‘Al- Mash’ar is of al-Muzdalifah and al-Muzdalifah is from al-Mash‘ar; only a little prayer is sufficient for them . ‘“

2. A number of our people have narrated from Ahmad ibn Muhammad from ibn Faddal from abu Jamilah from Muhammad al-Halabiy from Zurarah who has said the following: “This is about the words of Allah, most Majestic, most Glorious, ‘. . . those whom your right hands possess’ (24:58) abu ‘Abd Allah (a.s.), has said, ‘It is just for men and not for women.’ I then asked, ‘Is it then necessary for women to ask permission in such hours?’ He (the Imam) said, ‘No, they can come and go.’ About, ‘. . . those who have not gained feeling of carnal desire,’ (24:58) he (the Imam) said, ‘It is a reference to yourselves (free people).’ He (the Imam) said, ‘You must ask for permission, like those who have become mature, during the three hours.’”

Muhammad ibn ‘Isma’il has narrated from al-Fadl ibn Shadhan from Safwan ibn Yahya Mu‘awiyah ibn ‘Ammar who has said the following: “I once asked abu ‘Abd Allah (a.s.), about a man who leaves ‘Arafat and comes to Mina 5 . He (the Imam) said, ‘He must go back to al-Jam‘ (place of assembly) to stay there even if all people may have already left al-Jam‘ (place of assembly ). ‘“

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad and A number of our people have narrated from Ahmad ibn abu ‘Abd Allah all from Muhammad ibn ‘Isa from Yusuf ibn ‘Aqil from Muhammad ibn Qays who has said the following: “Abu Ja‘far (a.s.), has said, ‘Those whom your right hands possess and who have not gained feeling of carnal desires must ask permission from you three times: before the morning Salat (prayer), at noontime when you undress and after Salat (prayer) of al-‘Isha’ which are three times of privacy and thereafter it is not unlawful for you and for them to come and go and move around each other. Those of you who have gained feeling of carnal desire must not enter in the place of your mother, sister, daughter and others without permission and you must not give permission unless he offers you Salam (the phrase of offering greeting of peace) because it is obedience to the Beneficent.’”

[2]قوله:« مِنَ الظَّهِيرَةِ» بيان للحين. و قوله تعالى:« ثَلاثُ عَوْراتٍ» اما بالرفع كما هو قراءة جمع من القراء فهو خبر مبتدأ محذوف و تقديره هذه ثلاث عورات و اما بالنصب كما هو قراءة بعضهم فهو بدل من« ثلاث مرّات» و سمى هذه الأوقات عورات لان الإنسان ربما يكون عريانا في تلكم الساعات اما قبل صلاة الفجر فمعلوم و اما الظهيرة لعله للقيلولة و اما بعد صلاة العشاء لانه وقت التجرد للنوم و قال السدى: ان اناسا من الصحابة كان يعجبهم أن يواقعوا نساءهم في هذه الأوقات ليغتسلوا ثمّ يخرجوا الى الصلاة فأمرهم اللّه سبحانه بذلك.ص 530

4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Faddal from Yunus ibn Ya’qub who has said the following: “Once, I asked abu ‘Abd Allah (a.s.), about a man who leaves ‘Arafat and passes through al-Mash‘ar to Mina 5 without staying in al-Mash‘ar. In Mina’he throws pebbles on al-Jamarat and only when the sun rises high he comes to know. He (the Imam) said, ‘He must go back to al-Mash‘ar, stay there for a while, then return to Mina 5 and throw pebbles . ‘“

4. A number of our people have narrated from Ahmad ibn abu ‘Abd Allah from his father from Khalaf ibn Hammad from Rib’iy ibn ‘Abd Allah from al-Fudayl ibn Yasar who has said the following: “About the words of Allah, most Majestic, most Glorious, ‘O believers, those whom your right hands possess and those who have not yet gained feeling of carnal desire must ask permission from you three times’, (24:58) abu ‘Abd Allah (a.s.); and in answer to a question about who such people are has said, ‘They are male and female slaves and the children who are not yet mature. They must ask permission from you during the three hours of privacy; after Salat (prayer) of al-‘Isha’ which is al-‘Atmah, when you undress at noon time and before the morning Salat (prayer). After the three privacy times, your slaves and children can come and go without permission if they wanted.’”

5. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Muhammad ibn Yahya al-Khath’amiy who has said the following: “About a man who had not stayed in al-Muzdalifah and did not pass the night there until he arrived in Mina’, he (the Imam) asked, ‘Did he not see the people and recognize Mina 5 when he arrived ? 5 I then asked, ‘What happens if he is ignorant about it ?’ He (the Imam) said, ‘He must go back.’ I then said, ‘He has missed such chance .’ He (the Imam) said, ‘It is not harmful .’”

A number of our people have narrated from Sahl ibn Ziyad from al-Hassan ibn Mahbub from ibn Ri’ab from Hariz who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘If one leaves ‘Arafat with people, does not wait with them in Jam‘ and passes to Mina 5 intentionally or due to considering it unimportant, he owes one badanah.”’

[3]قال في الدروس: الوقوف بالمشعر ركن أعظم من عرفة عندنا فلو تعمد تركه بطل حجه و قول ابن الجنيد بوجوب البدنة لا غير ضعيف و رواية حريز بوجوب البدنة على متعمد تركه او المستخف به متروكة محمولة على من وقف به ليلا قليلا ثمّ مضى و لو تركه نسيانا فلا شي‌ء عليه اذا كانت وقف بالعرفات اختيارا فلو نسيهما بالكلية بطل حجه و كذا الجاهل و لو ترك الوقوف بالمشعر جهلا بطل حجه عند الشيخ في التهذيب و رواية محمّد بن يحيى بخلافه و تأولها الشيخ على تارك كمال الوقوف جهلا و قد أتى باليسير منه.( آت)ص 473
