1. Ali ibn Ibrahim has narrated from his father from Salih af-Sindiy from Ja‘far ibn Bashir from ’Abd Allah ibn Rashid who has said the following: “Abu ‘Abd Allah (a.s.), has said that a man may enter the grave of his father, but a father should not enter the grave of his sons.”

أَمَرْتُ رَجُلًا يَسْأَلُ أَبَا الْحَسَنِ ع عَنِ الرَّجُلِ يَأْخُذُ مِنْ رَجُلٍ حَجَّةً- فَلَا تَكْفِيهِ أَ لَهُ أَنْ يَأْخُذَ مِنْ رَجُلٍ أُخْرَى وَ يَتَّسِعَ بِهَا وَ يُجْزِئُ عَنْهُمَا جَمِيعاً أَوْ يُشْرِكُهُمَا جَمِيعاً إِنْ لَمْ تَكْفِهِ إِحْدَاهُمَا فَذَكَرَ أَنَّهُ قَالَ أَحَبُّ إِلَيَّ أَنْ تَكُونَ خَالِصَةً لِوَاحِدٍ فَإِنْ كَانَتْ لَا تَكْفِيهِ فَلَا يَأْخُذْهَا.

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn ‘Isma‘il who has said the following: “I once instructed a man to ask abu al-Hassan (a.s.), about a man who receives an amount to perform al-Hajj but it is not sufficient. Can he get additional amount from other persons to combine and make them as partners, or that al-Hajj is only for one of them? He quoted him (the Imam) as having said, ‘I like it to be for one of them only, but if it is not sufficient, he must not take such amount.’”

Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan ibn Yahya from ‘Is ibn al-Qasim who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man who divorces his wife who marries another man and gives birth from the second man; if her children from the second husband are lawful for the children of the first husband from his wife other than her. He (the Imam) said, ‘Yes, it is lawful. 5 I then asked him about the case of a man who frees his slave- girl who marries another man and gives birth from the second man; if her children are lawful for the children of the man who freed her. He (the Imam) said, ‘Yes, they are lawful.’”

Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Safwan and Ahmad ibn Muhammad from al-‘Asemiy from Ali ibn al-Hassan Faddal from al-‘Abbas ibn ‘Amir from Safwan ibn Yahya from Shu’ayb al-‘Aqarqufiy who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man who has a slave-girl with whom he goes to bed seeking to have a child, but does not become fortunate to have a child and gives her to his brother as a gift or sells her and she gives birth to several children; if his children from a woman other than her can marry the children of his brother from her. He (the Imam) asked me to say it again. I said it again and he (the Imam) said, ‘Yes, it is not unlawful.’”

3. Ali has narrated from his father from Ibn Abi ‘Umayr from Muhammad ibn abu Hamzah from a man who has said the following: “When Isma’il, son of abu ‘Abd Allah, passed away, abu ‘Abd Allah (a.s.), went to the grave site, allowed his body to reach the ground, and said, ‘I pray to Allah to grant you mercy and favors.’ He did not enter the grave; and he said, ‘This is how the Holy Prophet did when Ibrahim died.’”

A number of our people have narrated from Sahl ibn Ziyad and Ali ibn Ibrahim has narrated from his father all from al-Nawfaliy from al-Sakuniy from ‘Abd Allah (a.s.), who has said the following: “Amir al-Mu’minin (a.s.), has said, ‘It is of the Sunnah (tradition) of the Messenger of Allah that no one should enter the grave of a woman except those who could see her in her lifetime.’”

7. Humayd ibn Ziyad has narrated from al-Hassan ibn Muhammad al-Kindiy from Ahmad ibn al-Hassan al-Mithamiy from Aban from ‘Abd Allah ibn Rashid who has said the following: “I was with abu ‘Abd Allah (a.s.), when Isma’il, his son passed away. The dead body was brought down in the grave. Thereafter he (the Imam) allowed his body to reach the ground on the side of the grave facing the direction of Qiblah. Then he said, ‘This is how the Messenger of Allah did on the death of Ibrahim.’ He then said, ‘A man may enter the grave of his father but a father, should not enter the grave of his sons.’”

A number of our people have narrated from Sahl ibn Ziyad from Muhammad ibn al-Walid from Yahya ibn ‘Amr from ‘Abd Allah ibn Rashid from ‘Abd Allah al-‘Anbariy who has said the following: “Once I asked abu ‘Abd Allah (a.s.), ‘Can a man bury his son?’ He replied, ‘He does not bury him in the soil.’ I (the narrator) then asked, ‘Can a son bury his father?’ He replied, ‘Yes, there is no offense in it.’”

سَأَلْتُ أَبَا الْحَسَنِ ع- عَنْ هَذِهِ الْمَسْأَلَةِ فَقَالَ كَرِّرْهَا عَلَيَّ قُلْتُ لَهُ إِنَّهُ كَانَتْ لِي جَارِيَةٌ فَلَمْ تُرْزَقْ مِنِّي وَلَداً فَبِعْتُهَا فَوَلَدَتْ مِنْ غَيْرِي وَلَداً وَ لِي وَلَدٌ مِنْ غَيْرِهَا فَأُزَوِّجُ وَلَدِي مِنْ غَيْرِهَا وَلَدَهَا قَالَ تُزَوِّجُ مَا كَانَ لَهَا مِنْ وَلَدٍ قَبْلَكَ يَقُولُ قَبْلَ أَنْ يَكُونَ لَكَ‌.

3. It is narrated from the narrator of the previous Hadith from al-Husayn ibn Khalid al-Sayrafiy who has said the following: “I once asked abu al-Hassan (a.s.), about this case and he asked me to say it again and I said, ‘I had a slave-girl and I was not fortunate to have a child from her so I sold her and she give birth to a child from someone other than me and I have a child from a woman other than her; if I can give in marriage my child from another woman to her child.’ He (the Imam) said, ‘You can give in marriage to her children who were before you, before she became yours.’”

[1]الضمير هنا و في ما يأتي اما راجع الى محمّد بن الحسين لكن رواية محمّد بن الحسين عن الحسين بن خالد بلا واسطة لم يعهد به في الكتاب و الواسطة اما محمّد بن اسلم او محمّد بن مسلم الجبلى على ما في جامع الرواة. و اما راجع الى صفوان و الظاهر هو الصحيح لروايته عن زيد بن الجهيم في غير موضع من الكتاب، و اللّه العالم.ص 399

[2]قال في النافع: يكره ان يزوج ابنه بنت زوجته إذا ولدتها بعد مفارقته و لا بأس لمن ولدتها قبل ذلك و قال السيّد في شرحه: انما خص الكراهة ببنت الزوجة دون الأمة لاختصاص الرواية المتضمنة للكراهة بذلك فما ذكره جدى من أن الأولى التعميم ليس بجيد لان روايات الجواز عامة« بقية الحاشية في الصفحة الآتية»« بقية الحاشية من الصفحة الماضية» و رواية الكراهة مخصصة. و أقول: لعله لم يعتن برواية الصيرفى لضعفه عنده و لا يخفى انه على تقدير التسليم يصلح لاثبات الكراهة كما هو دأبهم في سائر الاحكام مع أن العلة مشتركة بينهما فتدبر.( آت)ص 399
